Below are most of my notes from the stakeholder's meeting with USCIS about DACA yesterday: Notes from USCIS Stakeholder meeting on November 19, 2012 Last Friday the USCIS.gov/childhood arrivals wensite was updated. Later today there will be new updates to the filing tips, and new FAQs as well as translations into new languages. As of mid November almost 300,000 applications have been received. On September 12th the Service began deciding these cases. So far 50,000 cases have been decided. Cases must have biometrics completed before they can be reviewed. So far all cases are within the four to six month goal. The Service will provide regular updates about processing times and numbers. Will misdemeanor charges of No license affect eligibility? Traffic violations will not be considered as non-significant misdemeanors regardless of how the state classifies them. However many violations will cause the case to be evaluated under the totality of the circumstances to determine if the applicant poses a threat to safetly. Why are there differences in processing times? Generally cases are “first in, first in right” however there are “immaterial deviations” in that due to processing times at different service centers and adjudicators. Is a conviction for breath test refusal a significant misdemeanor? Unknown If a person is 14 years old now, can they apply later? Yes. How many denials are there so far? Unknown. Because an RFE allows 84 days to respond, and a Notice of Intent to Deny allows 30 days to rebut, there is insufficient data on denials so far. If a person is denied can they re-apply? Yes. Can a person apply if they satisfy all but one requirement? No What if a person made a false claim to citizenship? Those cases are very fact-specific. They are evaluated on a case by case basis. Can a person apply if they have a final order of deportation? Yes Can a person use employment records even if they show a false SS#? Yes Can a GED program in Spanish qualify an applicant? Yes If an applicant has an order of deportation and receives DACA, can they reopen their deportation based on the grant of DACA? Yes. If a DWI has been expunged, can an applicant qualify? Case will be reviewed under the totality of the circumstances. Note- Cases are reviewed based on the convictions, not the original offenses. In other words a DWI reduced to “wet reckless” does not necessarily disqualify one for DACA. However the Service is not precluded from looking at the original charge because DACA is discretionary. Advance Parole will be granted on a humanitarian basis, on a case by case basis. Is there news about the Provisional Waiver Program? Expect it to be available THIS CALENDAR YEAR. quick question guys because im still not sure in order for me to go to the DMV and take the test for the restricted license do I have to complete the drug and alcohol test of for 4 hours online and then bring it with me to the DMV when im ready to take the test? thank you so much for the help!

Hello guys I'm currently studying the book for the driver license and i have to say for somebody like me that has never drove before omg it looks so difficult if you guys can share your experience regarding a driver license driving for the first time etc. thank you guys. if you guys can tell me more like when did you guys book the appoinment , how long did it take (how many days after you book the appoinment and so on)

Hello guys I got approved on april 3 and i went to the social security office on april 8 as in today I'm still waiting on my social security which i know it takes time I would like to change my last name but since i didn't take the marriage licensed with me then i will have to wait until my social gets here, the lady said i could change my last name once i received my social # and it will be at no cost the lady also said that once i bring the marriage license and the social security she could make the change, my question is those this mean i have to make the change of last name on my permit to work? and somebody told me that for a card replacement would be like almost 500? is that a MOST DO THING? because I'm going to do my driver license once i change my last name on the social.

hola a todos los que seguimos en espera de nuestra aprovacion felicidades a lo que ya an sido aprovados quiero decirles lo que me dijeron hoy que llame a uscis preguntanto hacerca de mi caso y bueno despues de explicarles lo del service request y todo eso la persona que me atendio me dijo que no habia un tiempo determinado para el la accion diferida? alguien mas le han dicho esto? sigan compartiendo sus experiencias y sus fechas y centro gracias!! -

I am curious to know since im waiting on the service request letter (which according to all the opinions we have seen in the forum about what the letters says ) which is to be patiance or to wait 180 additional days does it mean that i can get approved anyday now or after i recieved the letter? -

They allow me to do a service request on my case i couldn't be any happier and I know that my approval should be just around the corner I really hope so they told me to expect a letter in the mail by march 10 and since that's a Sunday I hope I get it by Monday march 11th thank you guys for the comments in my status but they were to many to reply to each and everyone like I want it to so I made this topic to thank you guys so much for the support.

I called today because last time I called they told me to call in a month so I call this morning and after I spoke to 4 representatives I heard the more confusing information of why my case is taking so long. The first, second and third representative told me to wait... still under initial review so I ask to speak to another agent and this is what she told me , it seems like your case haven't been assign to an officer as yet, I said excused me but is been 5 months since you received my application and she told me sorry but no officer hasn't been assign to your case 0-o I was confused so that's all she said to me so I decided to call back again just to make sure I understood right, and tis time this time this representative name jose told me that I should be expecting any news in the next 24 days!! lets see what happens in 24 days!!

If your case got transfer to another center you will received a letter in the mail saying this .... This is to advise you that in order to speed up processing we transferred the above case to the following uscis office for processing : Nebraska service center, p.o. box 82521, lincoln ne 68501-2521. that office will notify you of the decision made on the application or petición

I have called uscis 4 times now and every time I ask, when do I start counting , the moment they received my application or after the bios? And I always get the same answer they start counting from the day they received the application!! if you guys called please let us know what they tell you, Vermont center is slow but I really hope they approved me soon. good luck guys.

Pink stripe on illegal immigrants' driver's licenses considered in NC North Carolina Department of Motor Vehicles via WCNC The new North Carolina license declares to everyone that the bearer has "no lawful status." By The Associated Press RALEIGH, N.C. — A new North Carolina driver's license set to be issued to some illegal immigrants has a bright pink stripe and the bold words "NO LAWFUL STATUS," raising concerns about whether the design will brand those who show it. The North Carolina Division of Motor Vehicles announced last week that it would begin issuing the licenses March 25 following a lengthy legal review. The Obama administration's Deferred Action for Childhood Arrivals program grants valid federal work permits to qualified applicants brought to the U.S. as children without legal authorization. Some Republican lawmakers in the state have balked at the idea, filing a bill Thursday to bar the DMV from granting the licenses until at least June. Advertise | AdChoices Cinthia Marroquin, 22, of Raleigh, head organizer for NC DREAM Team, an immigrant rights group, is awaiting approval for a DACA permit. She said the longer the license issue is delayed, the longer it will take for her to get a job and drive herself to work. Even if she is able to get one, she is worried about presenting a license declaring she has "NO LAWFUL STATUS" at a police roadblock or while writing a check at the grocery store. "A lot of us are just scared," said Marroquin, who came to the U.S. from Mexico when she was 15. "We just want to be able to get a job and drive to work. Having that license is just going to show everybody you're here illegally, just buying a beer or writing a check. You don't know how people might react." The American Civil Liberties Union of North Carolina also takes issue with the designation. "North Carolina should not be making it harder for aspiring citizens to integrate and contribute to our communities by branding them with a second-class driver's license," said ACLU attorney Raul Pinto. "There is simply no reason for officials to stigmatize people who are in the U.S. legally with an unnecessary marker that could lead to harassment, confusion, and racial profiling." Almost from the moment President Barack Obama announced the program in June, states across the country grappled with how and whether to issue driver's licenses to those granted legal presence. Many states, including Oregon and Georgia, have announced that they will grant driving privileges to those eligible. In Arizona, where Republican Gov. Jan Brewer has pledged that DACA youths will not get driver's licenses, the state's DMV still lists federal work permits among the documents making people eligible for one. The issue is especially politically charged in North Carolina, where current state law ordains a driver's license will be issued to anyone who holds valid federal documentation of their "legal presence" in the United States. The office of the state's Democratic attorney general in an opinion last month said that under federal law, DACA participants have a "legal presence," even if they do not have "lawful status." Therefore, state law requires that DACA participants be granted licenses. Republican Gov. Pat McCrory's administration agreed, announcing last week the DMV would begin issuing the licenses. That has upset many conservatives in McCrory's own party, including Rep. Mark Brody, R-Union. He is one of four freshmen legislators who introduced a bill Thursday to bar the DMV from issuing licenses to DACA participants before June 15, potentially giving time to craft a permanent change to state law. Brody said he believes strongly that the DACA program violated the U.S. Constitution because it was implemented without congressional approval. Obama said last year he was forced to take executive action by the decades-long failure of Congress to consider meaningful immigration reform. "We need a time out," said Brody, a construction contractor. "We don't need to have the federal government dictating to us how we are supposed to issue licenses in this state. We do it, and that's a privilege we have under our Constitution." Among the concerns raised by Brody and other bill sponsors is that illegal immigrants might use their new licenses to access social programs or register to vote, despite the bright pink markings. An extensive 2011 review of the state's 6.4 million registered voters by the N.C. Board of Elections found 12 instances where a non-citizen successfully cast a ballot. Jose Rico, a 23-year-old Raleigh resident from Mexico who has already been issued DACA work permit, said he plans to be in line at the DMV on March 25 to get a license, even if it's pink. He will be extremely disappointed if state legislators pass a bill delaying or a denying his ability to do so. "I don't know what's wrong with these people, why they're so afraid of people like me," said Rico, who has lived in the U.S. since he was 13. "It's so frustrating. I passed a federal background check, done everything right by the book. I'm paying taxes. I mean, we're just kids trying to go to school." -
Hi guys I see a few have recieved a RFE or there case have been routed to another service center!! also now that people past the 6 months can start doing the service request and they tell you to wait 15 days to hear back about your case or why is it taking that long etc. I have this strong feeling that they are going to extend the timeline no doubt about it but thats just my opinion, because they are going to have a lot of aplications back up :/but I stil dont undertand why there are some cases were they just recently send their aplication and got aproved!! and no im not upset it all but im a bit worried because im looking forward this, please continue sharing your stories and timelines. for those of us that are still waiting it helps a lot.

Hello guys I know there is a lot of people that are still waiting to get approved , applications send since august and today February 15 is been exactly 6 months I really hope they don't make us wait past the 6 months to get approved but then again I will understand the delay, because of the amount of applications they received daily. please stay positive because is so worth the wait I waited 10 years for this opportunity and I cant wait to received the letter of approval good luck to all of us that still waiting and if you got approved congratulations!!!
