    There seems to be some confusion going on and I hope I'm not the one who's confused. If and When this bill passes and becomes law, everyone who is in this country illegally will apply for RPI within 6 months after DHS comes up with a plan for securing the border. RPI by the way is just like PR without the government benefits like foot-stamps...etc. If I read the bill correctly, which I think I did, RPI is not tied to border security. What is tied to border security is PR and Citizenship.

    Unlikely!, we would probably fill out a form for the RPI and possibly pay a fee (we don't know yet if there will be a penalty or a fee for Dreamers).

    The reason why they're not using the word Dream Act is because the process for the Dream Act is pretty much covered by DACA, they don't see a point of creating another program for "Dreamers", because that process is already in place. Its also important to note that this bill is going to change a whole lot when it comes to the Senate floor for debate.

    I didn't send anything for most of May, all of June and July of 2012, because my spring semester just ended and I didn't do really much of anything during the summer. I really thought I will get an RFE for June 15, 2012 but it never happened. I believe that the agent who was assigned to my case was smart enough to realize that I was just a college kid who was on a summer break by looking at my official college transcripts.
  9. Sometimes I don't understand why people like to make life harder for others. Life is short, we don't have another 15 to 20 years to waste, we've been waiting for decades already! I will have to wait and read the whole bill next week. All we're reading right now are just some broad outlines, we still have to see how the Dreamers will be handled. The farm-workers and the Dreamer's path to citizenship will be expedited according to earlier remarks from John McCain, and I'll be damned if the Dreamers will put in that 15 years waiting period.
  10. USCIS is laughable sometimes. Lol Since when did they process the applications in the order received? Anyway...just be patient and hopefully you'll be approved soon.
  11. I really suggest that you don't change ANYTHING at this point. Wait until you gain legal status to begin the process of changing your name. The whole immigration system will be changed completely if Congress pass CIR this year, which means things will get messy and complicated and the last thing you want especially now is to mess around. Whatever name that is on all of your DACA documents as well as your passport and birth certificate, its the name that you should stay with for now. Thats just my suggestion.

    I'm kind of confused. If you were barred from re-entering the U.S. for 10 years then how are you here? Did you cross the border after you were denied visa?

  15. It depends on how you entered the United States. If you enetered the United Sates without inspection (border crossing) then your out of lack, but if you enetered the U.S. with a tourist visa for example then you can change your status through marriage.

    Vandalism is not a pretty name to have on your record, but the good thing in your case is the vase you've allegedly broke is probably not worth much and that's why it's just a minor misdemeanor. The chances are that it won't negatively affect your DACA case.

    How strong was your evidence for continuous residency? If you have an extra $465 for the application, you should file another application and try to have strong evidence for continuous residency and also for June 15, 2012. Hopefully this time your application will be handled by a different person, rather than that jackass who denied you.
  18. Whatever is on your passport and your birth certificate is what you should put on your deferred action application. I honestly don't know if that would have any negative burden on your application but my guess is that it won't. I believe that the adjudicators will use their best judgement when it comes to names and other minors things. I had somewhat of a similar situation but mine was that my name on my birth certificate and passport was spelled differently from my other documents such as school records but that didn't stop them from approving me, so I think you'll be fine.
  19. Initial evidence is something which is listed as a REQUIRED document in your DACA application. In-other words Initial evidence are information that relate to your Identity and even your biographic information, documents like birth certificates, passports, marriage licenses...etc, or it could even be a copy of your high school diploma. Additional evidence on the other hand are NOT REQUIRED documents, but are just some additional information that USCIS need to see in order to make a determination on an application. If you've receive an RFE its best to wait for the letter, don't read too much in what they post on their case status website.
  20. Call them until you get the answer that you need. You are way over the processing time and they have to give you an answer as soon as possible. Try doing a service request as well. Don't stop calling them, honestly don't.

    You're right that they didn't state that anywhere, but the problem that I have with re-applying is how would that work? They didn't say that you CAN re-apply nor did they say that you CANNOT re-apply, but they did say that they will not reconsider your case once you've been denied. Do you see, what I mean or am I just confusing myself? Lol

    @ Marco-12 If you do re-apply, you're pretty much asking them to reconsider their decision, which they made it clear they wont accept. Your name, your biographic and your Biometrics information is already into their system. So how would that work exactly? This is an uncharted territories, I don't know how many people have re-applied after being denied but that's an interesting issue that USCIS have to clarify.

    I hate to play the devils advocate but, If you are denied for DACA. You cannot appeal and even file a motion to reconsider, USCIS made that very clear, but what you can do is request a review under only two circumstances or errors; First, If you believe that you were denied deferral based on an application abandonment; and second, if USCIS sent a request for evidence to a wrong address even though you've filed a change of address form, but USCIS will not review its discretionary decision. This denial is probably the result of failing to satisfy the RFE. Its very important to take the RFE seriously and submit exactly what they're asking for, its very rare for USCIS to deny someone after sending them an RFE, unless that individual failed to follow the RFE guidelines. What I would suggest for J_R602 is to use the service request management tools to request a review under the first circumstance, which is a denial based on an application abandonment, which by the way could be the case. If that doesn't work then just wait for the Dream Act to pass and if it does pass, you better not make the same mistake of sending insufficient evidence.
  25. I agree with PSWA83. Marco Rubio is getting on my last nerve, but I give him the credit for at least being part of the gang of 8. We really don't need "extensive" hearings on immigration, we've had those hearings way too many times before and we all know what needs to be done on immigration. The faster we get this immigration bill out of the committees and on to the Senate floor the better it will be.
