OK, so you are able to file your taxes for '09 as self employed, visit your tax person for this. Affidavits are accepted in certain occasions, don't relay on them. I know my friend got a letter from Boss mobile saying "thank you for been a customer since 2007" or something like that. Where were you living back then? Did you have a car?

have you worked? Ever went to the doctor, dentist? Did you have a bank acct, or a cellphone? you get the picture, right?

Are you sure is a social, not an TI number? 'Cause as far as I know if the SS#, name and b-date don't match the return is not accepted. Yes, you may use taxes as evidence, but you should submit other evidence as well, say school records, immunization card, etc

it's OK, don't stress I know it's hard, but you got all the documents, this is considered a misdemeanor and has happened once, do you remember the requirements? "If you have been convicted of a felony offense, a significant misdemeanor offense, or three or more other misdemeanor offenses not occurring on the same date and not arising out of the same act, omission, or scheme of misconduct, or are otherwise deemed to pose a threat to national security or public safety, you will not be considered for deferred action under this process." * A significant misdemeanor is a misdemeanor as defined by federal law (specifically, one for which the maximum term of imprisonment authorized is one year or less but greater than five days) and: 1)Regardless of the sentence imposed, is an offense of domestic violence; sexual abuse or exploitation; burglary; unlawful possession or use of a firearm; drug distribution or trafficking; or, driving under the influence; or, 2)If not an offense listed above, is one for which the individual was sentenced to time in custody of more than 90 days. The sentence must involve time to be served in custody, and therefore does not include a suspended sentence. So you are off the hook, be patient

yes they did asked for the court disposition, but like I say there is nothing, nothing at all, so he got a certified latter saying exactly that there are no records; this however was sent with the packet, so when the RFE was received he went to the PD to get the report, but they only keep them for 7 years so again he got a letter saying that. At the end the lawyer sent copies of both letters plus an affidavit explaining what happened.

oh yeah I ask that question, it turns out that when we go for our bios doesn't mean they get processed right away because it is done trough the FBI and they search through all records; however when your prints are taken by the police or ICE or whom ever it goes right into the system. I know of someone who is almost on the same citation as you, but she has yet to receive an RFE or approval.

it is important you notified them specialy if you have file income taxes in the past, so that you can have Social security credit transfer to your new SSN . This is the # 1800-829-1040

BTW 13 years ago my bf was detained because he was out after curfew, was taken in for finger prints and picture, was picked up by mom one hr. later and was told he had to do community service...he tried closing the record like you said, but there was nothing under his name at all, but still shows when bios are done! Dunno

For what you have written you were detained, so when you went for your bios it showed, the reason why they want the disposition letter is because the want to know what happened in court and what the "sentence" was ($350 no time or anything else), so if all this happened after you submitted your papers it's OK you just have to explain so and all the court doc will have dates to prove it, if it happened before it was sent you may say it was an honest mistake no big deal. I'm sure the lawyer will tell you more about the affidavit
