Theresa replied to art3mes's topic in Dream Act Questions & Answers
You should call them to find out if they even received your packet or if they sent you the biometrics appointment and was lost in the mail. If you sent a personal check you can check with the bank if it was cashed and they can give you a copy of the check from both sides so that you can get your receipt number that USCIS would have written on the back when cashed. -
They then should call USCIS inquiring about your approval and verification. They will need the information on your aproval letter. You can also self e-verify through USCIS web page
-
They should be able to e-verify and contact USCIS themselves too because you have been APROVED and you can show the Deffered Action approval letter on your 821D to your employer
-
Congratulations!!!

You are suppose to get a new employment authorization card with your picture. It come in a separate envelope sometimes at the same time of within days of each other. Would dmv accept the d-821 approval letter? (this is the Deffered action approval). My friend received them by 2 weeks apart. Check your case status for tracking number on the receipt of the EAD

Those Qualified For Daca With An Expunged Dui
Theresa replied to ViK's topic in Dream Act Questions & Answers
I found this article as well Crimmigration: DACA Approval after Notice of Intent to Deny By Christy Turovskiy of Philip Eichorn Co., LPA posted in Crimmigration on Sunday, January 4, 2015. Sometimes when applying for an immigration benefit, particularly when there is a criminal issue in your past (hence, crimmigration), U.S. Citizenship and Immigration Services (USCIS) will issue a Notice of Intent to Deny (NOID). A NOID basically states that USCIS does not find your filing to be sufficient for approval. USCIS will give you a limited period of time, as specified in the NOID, in order to respond with additional documentation and often legal arguments dependent on the issues. If you do not respond within this period of time, your case will be denied. Even if you do you respond, your case may still be denied. Everything hinges on your response. For Deferred Action for Childhood Arrivals (DACA), in addition to other requirements, an applicant must demonstrate that he or she has not been convicted of a felony, a significant misdemeanor, or three or more misdemeanors, and does not otherwise pose a threat to national security or public safety. Our Office recently had to respond to a NOID by USCIS for a DACA Applicant that was convicted of assault in 2003 after being charged for domestic violence. USCIS claimed that this conviction was a significant misdemeanor as an offense of domestic violence, thus making him ineligible for DACA. In order to be considered a significant misdemeanor for purposes of the DACA process, a misdemeanor must meet certain criteria, which USCIS alleged our client met. With roughly one month to respond to the NOID, our office drafted a detailed legal argument applying USCIS's recently issued policy guidance to our client's statute of criminal conviction. We provided USCIS with a clear legally sound explanation as to why our client's criminal conviction did not meet the requirements set forth by USCIS. We additionally provided and cited evidence from our Client's criminal proceedings. On December 24, 2014, just in time for the recent holidays, our office received the below approval notice for this client's DACA application. We can now use this recent approval notice to administratively close his currently pending removal proceedings and protect him from deportation. If you are planning on applying for DACA (or Deferred Action for Parental Accountability, DAPA) and you have a criminal conviction in your past, please consult with an experienced crimmigration attorney for the best possible representation. -

Must Return Your 3 Year Work Permit Card By Tomorrow!!!
Theresa replied to God_why_m3's topic in Dream Act News
People who were issued 3-year EADs after Feb. 16, 2015, are required by the USCIS to return them. People who were issued 3-year EADs on or before Feb. 16, 2015 are NOT required to return them. You will receive a 2 year valid one If you have to return yours and haven't done so, go to the nearest USCIS office to return it as soon as possible. -

Don't worry, you won't get penalized because people who were issued 3-year EADs on or before Feb. 16, 2015 are NOT required to return them. -

Theresa replied to brendat90's topic in Dream Act Questions & Answers
Brendat90, If you haven't received your EAD by now I suspect it was lost in the mail. That is a very long time. Call their national customer service line to ask them if they know anything about it. If you were aproved before February 16, 2015 you don't have to worry about returning anything but you do need to find out if your EAD was lost and go from there. -
Daca For The First Time, Taking Too Long
Theresa replied to brendat90's topic in Dream Act Questions & Answers
If you are a DACA recipient who received a three-year Employment Authorization Document (EAD) after February 16, 2015, it was likely mistakenly issued and must be returned to receive a valid one for 2 years. Note: anyone who received it for 3 years before February 16, 2015 does not need to return it. Anyone who received it for 2 years before or after February 16, 2015 does not need to return it. -
