  2. Over the past few weeks, I have been asked countless of times by potential DREAMERS if they qualify for DACA even if they are still taking classes to obtain their GED. I recently re read the guidelines issued by the USCIS for applying for DACA. It seems that due to my excitement I skipped this part of the GED since I obtained a HS diploma.. I apologize for my ignorance and for misinforming all those who asked me about obtaining a GED. YOU CAN STILL BE IN CLASSES GETTING YOUR GED TO QUALIFY FOR DACA. This is what the guideline on the USCIS website says: Who is considered to be “currently in school” under the guidelines? To be considered “currently in school” under the guidelines, you must be enrolled in: a public or private elementary school, junior high or middle school, high school, or secondary school; an education, literacy, or career training program (including vocational training) that is designed to lead to placement in postsecondary education, job training, or employment and where you are working toward such placement; or an education program assisting students either in obtaining a regular high school diploma or its recognized equivalent under state law (including a certificate of completion, certificate of attendance, or alternate award), or in passing a General Educational Development (GED) exam or other equivalent state-authorized exam. Such education, literacy, or career training programs include, but are not limited to, programs funded, in whole or in part, by federal or state grants. Programs funded by other sources may qualify if they are administered by providers of demonstrated effectiveness, such as institutions of higher education, including community colleges, and certain community-based organizations. In assessing whether such an education, literacy or career training program not funded in whole or in part by federal or state grants is of demonstrated effectiveness, USCIS will consider the duration of the program’s existence; the program’s track record in assisting students in obtaining a regular high school diploma or its recognized equivalent, in passing a GED or other state-authorized exam, or in placing students in postsecondary education, job training, or employment; and other indicators of the program’s overall quality. For individuals seeking to demonstrate that they are “currently in school” through enrollment in such a program, the burden is on the requestor to show the program’s demonstrated effectiveness.   3. Hi Everyone!!! Havent been online as often as I'd like...work and getting ready for school has kept me occupied. Approval from DACA is guarenteed to open many new doors and possibilites for all.. Well, heres what this post is about...taxes... This is my first legal job ever, before DACA I worked under the table and never filed taxes... Well this job, every paycheck withdraws taxes... Ive been reading up on doing taxes and the different categories..nonresiden and resident.. DACA didnt provide us with any type of legal status, however Publication 519, the US Tax Guide released by the IRS, categorizes us as resident aliens because of the time we've been here (page 5).. They even have this little table that helps you determine what to file under.. I will be filing as a resident as indicated by Publication 519 because of the time I've been here in the US, I mean we obviously had to meet that requirement to get qualified for DACA.. For any Android users, theres a free app called "TaxCaster" from Turbo Tax and gives you an estimate of how much you'd be getting back..its really user friendly.. Now all I have to wait is for my W2 from my employer at the end of Jan. and get back some of those taxes...     Hi everyone!!!! Hows everyone doing collecting their paperwork for this Deffered Act? Im ready!!!! Got all my school documents and transcripst and after I graduated I did a bit of volunteering at local childrens schools, so I have paperwork for that. I also have copies of my leases and bills to show where/when I have resided at different locations.. Hope everyone is as ready as I am.....

  7. Currently all we know is that the application will be released the 15th of august, but do any of us know how to file our paperwork? Well,heres some interesting info from the USCIS website with the link provided at the bottom of course...good luck to you all.. General Tips on Assembling Applications for Mailing Mark both the envelope and the cover letter as to the nature of the submission. Example: ORIGINAL SUBMISSION - BRIEF FOR AN APPEAL - RESPONSE TO REQUEST FOR ADDITIONAL INFORMATION - etc. Use the appropriate mailing address and mark both the envelope and the cover letter as to the form type. Example: I-129; I-130; I-690; I-698, etc. Provide both the receipt notice number and the A-Number as an identifier, if they are available. If the packet is being resubmitted in response to a REQUEST FOR ADDITIONAL EVIDENCE (RFE), please place the notice requesting the additional evidence/information on the top of the packet. Also, please use the special mailing envelope provided. If evidence is being submitted in support of a previously filed appeal or motion, a cover letter stating "BRIEF FOR APPEAL", etc., should be placed on top of the packet. In preparing your packet, please take note of the following: Do not use binders or folders that cannot be easily disassembled. Use ACCO fasteners to hold together thick or bulky applications or petitions. Two-hole punching the top of the material for easy placement in the file is appreciated. The use of tabs assist in locating items listed as attachments. The tabs should be placed on the bottom and not the side for ease in filing. Avoid using heavy-duty staples; instead use ACCO fasteners or heavy clips. Avoid submitting originals unless specifically required. Avoid submitting oversized documentation when possible. [*] If you are sending more than one case in an envelope, clearly separate the cases by rubber band or clip fasteners. [*] A form G-28 is not acceptable unless signed by the authorized representative and the petitioner (re: petitions) or the applicant (re: applications). Facsimile signature stamps are acceptable for the signature of the representatives. However, applicants/petitioners must live sign the initial Form G-28 submitted with the application/petition. Any subsequent Form G-28 relating to the same case may be a photocopy of the original, which should be already attached to the relating case. [*] Send copies of any prior approval notices with any new requests for extensions of stay, change of status or amended petitions. [*] Keep copies of all submissions. Don't assume the officer will have access to a prior file or record. Submit as complete a packet as possible so the case can be adjudicated from what you submit. Submit a complete packet of information for each petition or application. If officers have to review prior files or records, the adjudication of the case can be delayed substantially. [*] Be sure to complete all pertinent items on the petition or application. Ensure all entries on the forms are legible. Note the appropriate consulate, embassy, or a request to adjust status on the petition. Do note enter "N/A" when "None" is appropriate. [*] If you believe your situation to be unique, explain it fully in an attachment to the packet, not as a cover letter. [*] Please submit certified translations for all foreign language documents. The translator must certify that s/he is competent to translate and that the translation is accurate. The certification format should include the certifier's name, signature, address, and date of certification. A suggested format is: Certification by Translator I [typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________. Signature_________________________________ Date Typed Name Address [*] USCIS no longer routinely requires submission of original documents or "certified copies." Instead, ordinary legible photocopies of such documents (including naturalization certificates and alien registration cards) will be acceptable for initial filing and approval of petitions and applications. At the discretion of the officer, original documents may still be required in individual cases. Please be advised that USCIS no longer returns original documents submitted with the exception of Certificates of Naturalization, Forms I-551, Permanent Resident Card, Forms I-94, Arrival/Departure Document, valid passports, or those specifically requested by the officer. Such documents will be returned when they are no longer needed. [*] Reminder: The best way to locate records is through the receipt number and/or the A-Number. Always provide this information whenever possible. If you don't know the A-Number, provide a COMPLETE name and date of birth. [*] The address block on the forms is the data field captured for all of our mailings. Consistent with the limitations on the number of characters per line (a maximum of 32) and the total numbers of lines (4) in that field, whatever is in the block will become the mailing address used by the system. The data in these fields is entered exactly as indicated on the forms. Please include internal routing symbols in the address block, especially for large organizations. It is better to abbreviate the name of the organization and have space for the routing codes than to fully spell out the name and have notices sit in the organization's mailroom. [*] Recognized authorities: Many I-129 petitions filed with evidence of the beneficiary's education or accomplishments include documentation submitted by various authorities. For example, petitions for artists and entertainers may incude evidence the beneficiary has received an award or other recognition of achievement. Petitions for individuals employed in a specialty occupation may include evidence the beneficiary belongs to a professional organization. When an individual's awards or membership is used to support a petition, evidence establishing the reputation of that organization must also be submitted. Examples of the type of evidence needed includes the following: the size and standing of the organization or the organization's requirements for membership and any other documentation which would establish the reputation of that organization. When an opinion from a recognized authority is submitted, the opinion should state: the writer's qualifications as an expert; the writer's experience giving such opinions, citing specific instances where past opinions have been accepted as authoritiative and by whom; how the conclusions were reached; and the basis for the conclusions, including copies or citations of any research material used. [*] Any application or petition for an individual currently in F-1 status needs to include evidence the student has been maintaining status and has been authorized employment if applicable. Such evidence usually can be satisfied by submitting the latest Form I-20AB/I-20ID and a copy of the employment authorization card.       Thanks girls. Keep your chin up Bahama Girl, if it gets very difficult, I'd suggest speaking to an officer at USCIS, I've spoken to them before when I've felt my case was taking too long and they are helpful.

      Congrats !!! did you have to go into unlawful presence? dose you renewal start when your old one expires?

      Sorry for all the questions I'm just worried about my case I haven't heard anything I went to my biometrics on 8/6 and I don't want to go into unlawful presence as I would lose my job that I really love.

  10. @jessevigil: I did it by myself. More affordable that way & I didn't have problems the first time.
  11. Car Loans

    I was approved for DACA in Oct 2012 and had the same problem applying for car loans due to lack of credit. I bought a used car wish cash in hand. I also recommend going to local used car places, they may be more willing to work with you. Hope this helps.

    Be patient, remember a lot of us that applied for DACA in 2012 are now applying for renewal soo that wait may be a little longer...

  14. Biometrics Appointment Letter

    It also depends on your service center. I applied for my renewal for DACA on June 9th, they got it June 11th ( I expedited it). I received email & text with receipt # on June 13th. I got physical letters with same info June 17th. On June 23rd I got biometrics appointment for July 10th. Hope this helps.
  15. @holdingon2promise: Seems there is a confusion, I never said you said it would be the DREAMER's fault if they didn't renew on time. I made that as a general comment that it is not our fault if USCIS doesn't go through our application on time. When you say, "People can get caught up in life and may not realize time is running out. As a premed student I would never remember... Ever"...I understand people get caught up with things, but something as important as renewing your EAD in order to work and study should be at the top of your list. There are calendar apps that can remind you of important events. I work full time at a law firm and am also a pre med student attempting to get into the surgical field and want to continue on this path, so I have made it a priority to stay on top of these dates. Hope you receive your EAD very soon...

  17. You can try and blur it out but just remember it may raise a few more questions. Do you still have contact with a manager at that old place you used to work with? if so, if its only for verification purposes, there should be no problem with them verifying with that manager. Just make sure to stress out to that manager to please not disclose your SS#.

From what I recall reading on the USCIS website, as long as you sent in your renewal package in the time they recommended.......if theres a back log that is not our fault, and our EAD expires, you can keep on working..here's what they have on their website: If your previous period of deferred action expires before you receive a renewal of deferred action under DACA, you will accrue unlawful presence and will not be authorized to work for any time between the periods of deferred action. For this reason, USCIS encourages you to submit your request for renewal 120 days before your current period of deferred action under DACA expires. BUT......... Note: If USCIS is unexpectedly delayed in processing your renewal request, we may provide deferred action and employment authorization for a short period of time until we finish processing your request. We may do this if you filed your request at least 120 days before your current period of deferred action and employment authorization expire. This is why I sent my renewal package close to the 4 month mark to bypass this paperwork b*^$#*%t.
  19. Are Dreamers Considered Legal Residents?

    Up to where I know DACA doesn't give us any type of "status". We are neither citizens, temporary or permanent residents. I got my EAD in Oct. 2012 and have been working since then. I applied for TASFA and have been getting about $2000 per semester, excluding summer semesters. I'll be done with my basics this fall 2014 and entering my desired program in March 2015. Hope this helps.

    Biometrics are annoying in the sense we have to take 1/2 a day to a full day of work off to go do.The last time I was in & out in 20 minutes. I'll be asking for 1/2 a day.

    When I first applied in 2012 they were a bit strict about waiting 10 days to apply for your SS card..I think I waited minimum 4 days. Its an issue of letting the left hand get caught up with what the right hand is doing.

      Hi itzel so happy for you... I remember two years ago when you where nervous because you didn't get helped from a lawyer and you thought they where taking for ever jajaj and look at us now !!!

      I don't quite remember the lawyer part lapanch77 since I've always filled out my forms by myself to save myself the $ and time of a "middle" guy. I didn't they took forever since I received my DACA 55 days after applying, but thanks for remembering me. Hope you're doing good.
