Rep. Steve King (R-IA), one of the right’s leading anti-immigration voices, is planning to sue the Obama administration after it announced that it would stop deporting undocumented students who were eligible for the DREAM Act. Obama’s policy, which was unveiled last month, will protect up to 1.4 million young immigrants from being deported as the DREAM Act stalls in Congress. In response, King, who sits on the House Judiciary Committee, is promising swift action. In a tele-townhall late last week, the Iowa Congressman was asked about stopping illegal immigration. King said that he would soon file suit against the president “to command the president to enforce the law.” KING:I want to stop the bleeding at the border. I want to shut off the job magnet. I want to force the president to enforce the law and this litigation that I’m bringing forward that will be filed sometime soon will be asking for a writ of mandamus to command the president to enforce the law. That’s a constitutional provision we can implement. We know the president doesn’t want to enforce it. He’s said he will not. Despite King’s belief, the president’s immigration directive is eminently lawful. In fact, when the Supreme Court invalidated most of Arizona’s controversial SB 1070 immigration law last month, the majority opinion provided strong support for the new immigration policy. Still, even if King’s lawsuit flops, undocumented youth could again find themselves in danger of being deported if Mitt Romney prevails in November. The campaign co-chair, Ray Walser, announced last month that Romney would “rescind” the immigration directive if elected. New Information on Deferred Action for ‘Dreamers’ Being Released

Lets hope that the case, that they only deny people with serious time or commited a felony. However, in my personal opinion it seems as if theyre trying to only let through those with a very clean record. They seem to be trying to find any reason to deny someone and let in the least # of people apply. Hope Im wrong.- 3 replies

Mayra: Im not sure what would be the most important thing, but in my personal opinion, itd be your immunization card. That card shows continuous process in the country and where and when you got your shots. Most information should be released tomorrow August 1st and information about where to go should also be available tomorrow. Regarding a lawyer, its recommended getting a lawyer if you feel for some reason you could be denied dut to misdemeanors or any other reason. Good luck and welcome to the forum.

Hi KokyAmador: I dont know what to tell you regarding you obtaining your criminal record, Even if you cant obtain your criminal record, when you apply, they'll be sure to find a way to obtain a criminal record, the best one being the FBI. Welcome bobbyboxer, At the moment all we can be thankful is the DACA. I must tell you that you sound like a very intelligent young individual and I know exactly how you feel, but you are one of the lucky ones. DACA has come in time for you to be able to apply for scholarships grants and be able to work. Many of us graduated years ago and like you felt crushed and have been in limbo. You may not realize your dreams at the same time ad your peers, but I am 100%confident you will realize them. Look at it this way, you're just getting a late start but once you start, there'll be no stopping you. Good luck and welcome to the forum.

Hi green: The "talk" has been it could take between 60-90 days to get a workers permit approved. However, due to the probable large # of people applying it could be 6-12 months, like I mentioned this is all speculation. Good luck and welcome to the forum. -
Hi Maritza: The DREAM Act and the Deferred Act, better known as DACA are 2 different things. The DREAM Act hasn't passed, the DACA was the one Obama passed June 15. At the moment you can only apply for DACA if you qualify. Enter the blogs and you'll learn more about this. More info regarding DACA will be released August 1st and we can apply August 15. TGIF: I don't really think it matters what state you start the process in. You will be put through a background check. All that info will come out in the check. Hi Hope: Theres only one that has passed. Its the DACA. Deferred Action for Childhood Arrivals. You do qualify for this. With this, you'll be able to obtain a workers permit and a social security number which will help you get a drivers license. This permit does not grant residency nor citizenship and will be renewed every 2 years unless its dropped by the next president or unless the DREAM act passes. The DREAM act hasnt passed yet but thats the one we'd really like to be passed, itd be more beneficial for us if it does. Ian; The article was an interesting read, and thank you for sharing it. I find that it the foreign corn, can be compared to most DREAMERS. I'll use myself as an example. I am 100% fluent in both English and Spanish. I was born in Mexico, but was brought to this country at the age of 3. I received all my schooling here and when I had the financial means to do so, I did take few college classes. The few times that I have interacted with people originally from Mexico, who know the customs and culture, they have pointed out, that even though my Spanish is flawless, its easy to tell I didnt grow up in my home country. I can be easily identified. I feel that many of us DREAMERS, if we were deported to our birth country, because I do not call it our home country, I call the United States of America my HOME country; we'd be easily pointed out and could get into troublesome situations or even be taken advantage off. Its similar to cases where wolf pups are removed from their mother's side and raised in "civilization". When the pups, now full grown, are returned to their original environment, they have to adjust quickly or face the danger of being killed or ousted. It'd be a similar situation for us..like an acquaintance once said to me after I mentioned my situation, "How can a country you've known as your home throw the sheep into the wolves den?" Of course, me, us, the DREAMERS, being the sheep... Thanks for sharing.

Im glad to hear you are one of the lucky ones to have the $ to pay for the fees required to apply for DACA. But yes, you're right, for many others, itll be difficult to come up with the money when we havent been able to work..

jackdae: It seems that as of now DACA, will not permit us to join the military. My personal opinion, not from anywhere that Ive read, is that they wont let us join the military because this is a temporary fix, they do not offer us a path to temporary nor permanent residency, neither citizenship. By being permitted to join the military, it'd be very easy to become a citizen after a # of year. Good luck and welcome to the forum.

Hi asanchez: From what you mention, your sister was caught shoplifting at 13 and they said once she turned 18 itd be erased. My question for you is who are THEY that said that itd be erased? I dont have an answer for you but I'd recommend if I were you and your parents to contact a non profit organization of attorneys that help immigrants that qualify for DACA to answer this question. Mr. Benouis: Welcome to the forum. Thank you for joining and providing us with your info/input. I just read your article, regarding the CLE on DACA, and yes, its a crappy acronym, but its a dream come true for many of us that have been waiting for a chance/change. I look forward to many enlightening/interesting conversations with you on this forum. One of the things that caught my eye in this article was that Obama may have announce the DACA for being a president responsible for more deportations than any other president in history. That maybe the case and Its sad, but this action to me is a blessing from above and the reasons he did it don't concern me too much. I think the part of the article I got most excited for was the following: (They discussed the information from the San Diego meeting that USCIS will likely use a form that is a variation of the I-821 probably called the I-821D. There will likely not be a charge for this, but there will still be the $380 charge for the work authorization permit and $85 for the biometrics.) If this information proves true and there is no charge for the DACA application, it'd be a dream come true for many of us. In a recent poll 50% of us dont have the $1000 fee we had estimated it to be and this is without counting any attorney fees. Many of us, including myself, had considered filing our own paperwork to avoid expensive attorney fees. The only part of this article that did sadden me was that there is a possibility that the process can take from 6-12 months. I had hoped it would only be 60-90 days but now I realize that with soo many applying, we could all be delayed in the process. I'd appreciate any type of comment you have regarding what I just have posted Mr. Benouis and once again, Welcome to the forum!!!

Edith: As I mentioned before, I suppose the cost of the whole process maybe close to 930, just like Aled, I agree the process isnt going to be cheap and in my personal opinion, it has to cost us something, so the Republicans wont have something else to complain about. I hope I am wrong about the cost, but its always better to save the money and be safe than sorry... Good luck Edith and welcome to the Forum.

It seems to me possibly you dont believe the fee and I hope with all my heart that you are right and that the fee is wrong, because thats a lot of money and I dont have it all saved. Im working on getting it. You can believe it or not as the article says and the article even mentions possibiilities of waivers but that can change. Nothing in written in stone until the day we are applying and we have the application in our hands. I will be completely honest, I dont like your comment of the price that was given to others being false. I think I have said countless of times that when I try and help someone, I try and provide links to where I got this info, yes this info maybe wrong but Im not talking out of my a**. I feel by your comment as if you mentioned personally that info that I gave out is false. Please be more careful in the future. That is all I have to say regarding the subject, regarding your "comment about false info"

Im glad you read the article and I guess everyone understands it differently. The 465 is the number I understand to be the fee for the deferred act and until something different is announced and I will be saving up that amount. I really hope Im understanding it wrong and dont have to save such a high number. Like you mentioned, we'll wait until august 1st and see....
