How Long After Rfe Did You Get Approved ??
pswa83 replied to SaraMaravilla's topic in Life After Deferred Action
besides everything stated upon, i also think it would depend on the agent looking at your case and their workload. as well as how fast or slow they work. everyone's timeline is going to be different. USCIS states that a response should be given within 60 days of receiving the RFE. also, once USCIS approves DACA, they have 90 days to make a decision on the EAD. now, i am not saying this to be mean or anything but just to be realistic. everyone has different time lines and thus should not compare theirs to anyone else's . RFE or not. -
it will not delay your process. however, you should also change your address with the post office so that all your mail gets forwarded to the new address. i have always listed my permanent address as my mother's and she moved shortly after i applied. so i filed the AR-11 online as well as mailed the paper form and changed my address with the post office. doing all 3 covers all your bases. the sooner you do it the better. it should take about 2 weeks from the time USCIS gets the AR-11 for them to update your address. also, being approved or denied for DACA will have no affect on any other applications you have with USCIS unless you apply for advance parole (to travel out of the US for certain things).

Case Status Information For Receipt Number???????
pswa83 replied to TheGame1990's topic in Dream Act Questions & Answers
best thing to do is wait for the actually letter. after getting the letter, make sure to calm down and read it slowly. lol then go point by point and gather your evidence. make sure to mail the blue sheet back with your evidence. -
depending on how it was sent (express mail, priority mail, etc) it will take a few days (at most) to get there. then once there, it will get opened to make sure that you signed all the right forms and sent the right fees. when that is complete (it can take about 2 wks or so) then you'll get notified that your case has been accepted and sent to a Service Center. then your case will show "initial review" until either a decision has been made or a RFE has been issued.

i would assume since they transfer the check in electronic funds, as soon as you receive notice that your application was accepted then at that moment. what is your timeline?

i havent applied for AP and honestly am waiting for CIR in order to travel out of the US. however, i would advise you that if you are planning on applying for AP, that you have a real legit reason to do so. Educational purposes, Family Emergancy (or death) Humanitarian reasons). those are really the only reason why USCIS would grant AP. AP doesnt work just if you want to travel out of the US for pleasure. gather as much evidence you can for the reason you are wanting AP. letter from the school stating you've been accepted to study abroad with exact dates and as much information as possible. letter from a doctor treating your loved one stating the grave nature of his/her condition or a letter stating the death of said person. the thing is, is if, you apply for AP and get denied then it's kind of a waste of money so it's best to have all your evidence and all that in order before you apply so the chances of you getting denied are slim.

between 3 and 5 days depending on when USPS picked it up from USCIS. once it's picked up there should be a tracking number in your online status and you can track it that way.

i checked with friends and family first. my mom works at a hospital and my first job after DACA was at the same hospital, then got a job as a 911 dispatcher for a neighboring city and now i work back at the same hospital i started at. indeed.com monster.com shot, even craigslist sometimes has legit jobs. i have a friend (she's a USC) who got a job that was posted on CL. the key is to apply at everyplace that will take your application. it may not be your dream job but until you do get your dream job, every job you work gives you experience and is a stepping stone to your dream job.

i have to agree with JoseG on this one. the response time for the RFE does state to expect a response within 60 days.

they're telling you just to get you off the phone. everytime i called (before my case was approved) to correct my last name, i always got a different person and a different answer. even writing emails to the Service Center didnt help much. i finally had to wait on the phone for almost 2 hrs just to get someone to help me and correct the error. but like i said, you should just wait till maybe this time nxt week (i know, its hard to just sit around and wait) then call again and see if you can talk to someone who is a little nicer (fingers crossed)
-
i do not see why the waiting period would start over just because you received an RFE. there have been people who received an RFE that got approved shortly after sending back the RFE and other have waited longer. i would give it a little more time, call again and ask to speak to a secondary CSR about your case.

meh, honestly, it doesnt really bother me, just because i know that when i go to the hospital NO ONE pays my bill but ME. i have never gotten "free" health care. not even when my mom was on public assistance when we were younger. WHY?? because i didnt have a SSN and they wouldnt give me any benefits. how true this story is and to what degree would be very interesting. i could probably make up a story of some off the wall topic and there are going to be people out there that will be believe it.

if you have them for every month that is being asked then use them. if you can download them online then even better. i used all my utility bills (from every month) as part as my evidence.
-
if you deposited them in the bank, then i would use bank statements instead of the pay stubs.

Marriage To Usc After Daca Approval
pswa83 replied to x_deleted_x's topic in Dream Act Questions & Answers
your best option with this would be to go to a lawyer. yes DACA would prevent someone from being deported if they commit a minor crime but not sure how it would work with DACA. there is a hardship waiver that your spouse can file in order to have the ban waived. meaning that if you had to leave the US, the 3 to 10 yr ban that one would inquire would not be placed on them. but like i stated, your best bet would be going to a lawyer. -
just because you have tickets doesnt mean that you dont qualify for DACA. if your committed a SERIOUS crime then, yeah, you wouldnt qualify. but there have been people who have had tickets who have been approved. also, the USCIS agent looking at your case can use their judgement in determining all factors of your case. so you never know, you could be approved.

Does Daca Allow Us To Establish Residency?
pswa83 replied to edxxx's topic in Life After Deferred Action
i think if you can establish that you have lived in CA for a year, through utility bills or rent receipts then you can apply for in state tuition. i would make an appt with an admission rep to find out your residency options as opposed to just talking to someone at the admission desk. i know when i applied to college (back in 2004) i had to get the Dean of Admissions to sign off on my admissions even though i did graduate from a CA high school. it might take a little extra work but if you can get CA residency for school then it will save you TONS. Good Luck!! -

i believe they also deal with other issues as well. What Types of Problems Can the Ombudsman Help Me With? The Ombudsman may be able to help if: You are facing an emergency or hardship caused by a mistake, error, or delay by USCIS. You are experiencing a problem with your application or petition that you have not been able to resolve with USCIS. Your application or petition is pending beyond USCIS processing times. The Ombudsman is not able to help if: You are seeking legal advice. The Ombudsman does not provide legal advice. You are seeking assistance with an issue that does not involve USCIS. The Ombudsman’s authority is limited to assisting with problems that relate to USCIS applications, petitions, or services. NOTE: While the Ombudsman’s Office provides impartial and independent recommendations to USCIS on how to resolve problems, the Ombudsman’s Office does not have the statutory authority to make or change USCIS decisions.

oh, that sucks that you're husband couldnt apply for DACA. but if i'm reading it correctly, once you're able to apply for PR, then you can place your husband on your application as well. therefore, hopefully giving your husband status once you became a PR. yeah, i've been waiting for a family visa since 2001. but if 5 yrs is all i have to wait to be a PR and still be able to travel out of the US, then that's fine with me. i've already 12, whats another 5? lol...it's better then 10 or 13.
-
if he has been approved for DACA and has a valid DL, then he's not going to be deported if he gets pulled over. also if he is DACA approved, then once CIR passes he will be in a better position and will only have to wait 5 yrs before applying for PR but will have a valid visa so that he can work and even travel out of the US without AP

ok, another question....(and maybe i'm thinking too far ahead) in reading the 19 pages, this popped out at me: "The bill eliminates the backlog for family and employment-based immigration, which for some amounted to more than a 20-year wait. does this mean that those already in line waiting for a family visa, can apply for PR and skip the who 5 or 10 yr wait for PR?
-
bascially it means that IF and WHEN they THINK the border is "secure" then people can apply for residency. if, correct, DACA applicants will not have to wait the 10 years in order to apply for PR.
