  2. from what i understand, not everyone will be able to apply for citizenship right after they apply for PR. we'll just have to wait and see who will be about to apply for citizenship shortly after applying for PR

    no, we will more then likely send a copy of our DACA approal letter and our EAD. but not all the evidence we sent with the DACA application.

    yeah, that's usually how it works. if they sent back your application before the RFE, it means that your application was not filed out the right way, or your forgot to sign it or the payment was missing.

    true. i do and did. i'm real anal about my paperwork and still have medical records from when i was little. best thing to do is just wait and if you find anything that you think would help and save it just in case you do get an RFE. that way, you can see what the RFE is asking for and see if you have it allowing you to send back the RFE quickly.

    when you say you sent "at least one file for each year" what does the file entail? is it just one thing for the whole year? if thats the case then, personally, i dont think that would meet the requirement for residency. however, if it is evidence for every single month for a year, then that would meet the requirement.

    if you only sent a few items for every year, then the gaps of time are going to be greater and therefore the USCIS officer looking at your case will have more reason to issue an RFE asking for more evidence to establish enough ground that you meet each requirement.

    i would consulate a lawyer. most of the time lawyers give free consultations. i would go in and tell them the situation and see what they say. applying with just a ticket might cause an RFE to be issued in regards to the manner of the ticket but having an active warrant for your arrest is a little more serious then just a ticket.

    ok, question. in reading the proposed bill, i keep seeing the "DREAM Act" used. is the bill using the "DREAM Act" and "DACA" interchangably?? from what i understand the "DREAM Act" and "DACA" have 2 sets of requirements. also, wondering this because "DREAM Act" never passed.
  14. last time i flew was back in 2006 and all i used was my matricula (if you're from mexico). it was valid at the time. i also had my passport but didnt even use it. but yeah, just like everyone else said, if you already have your state ID or DL, then that's all you need. no need to carry your EAD.

    yes, like others have said, it would be nice to know what evidence you sent in regards to this issue. even if you think that you sent enough evidence, the decision is up to the USCIS officer reviewing your case. if THAT officer feels that you have not met the requirements, either initially or after an RFE, then your application will be denied. as it has in your case. when sending evidence regarding the "continuous residency" it is always best to send evidence from every month from every year requested. if you can send more then one evidence per month. i can only imagine how disappointed and sad you must feel, not only because you've been denied but also because you can not appeal this decision. my advice to you would be to save all your evidence and wait till CIR passes and go from there. really, that's kind of your only option at the moment other then getting married for papers. (which is a crime, if caught) i do wish the best for you (i honestly do) and hope that you can find the silver lining in all this.
  16. until anything solid comes out then we cant guess as to who is going to get what and when or how long it's going to take. some people, may only have to wait a few yrs before being able to apply for citizenship and others may have to wait much longer. will everyone, across the line, think it's fair, NO. but with issues such as this, not everyone is going to be happy. whose "they" and why wouldnt they get a work permit??

    why would it be an issue? just have to post the main body of the letter stating the denial, no personal info. i dont think writing the USCIS officer that denied you is going to help. the officer had reason to request an RFE, then after receiving the RFE, the officer made a decision based on the evidence you sent. also, Mark Hazuda, is the Deputy Director of the USCIS Nebraska Center so the signature on the Notice of Action letter is probably not the person who reviewed your application and evidence. also, one can ONLY appeal a decision IF and WHEN the error was made on the part of USCIS and not the petitioner and/or representative.

HAHAHAHAHA, as opposed to ALL the Americans that are public charges. oh yeah, let's all one day get up in the morning and say, "hey, lets just do what so many Americans already do and sit at home, watch tv, and wait for a monthly check so we can live off other peoples money." I DONT THINK SO!!! also, while we're waiting to AOS in those 10 years, wont OUR tax money go to support those AMERICANS on welfare and what not?? moving on... $2000 seems reasonable. I mean, now that most of us have jobs and fingers crossed will still have jobs within the waiting time. i would be more interesting in seeing how much the application fee is going to be. along with any other applications we're going to need to file as well.

  25. what Rawf statesd. USCIS still has 90 days to approve the I-765 after approving the I-821D. if i remember correctly, there is a member on this forum who either is still waiting for the I-765 approval or just received it after 90 days of her I-821D approval.
