Jessica, This guy got picked up by ICE after he got denied for DACA? Was a simple DUI misdemeanor & where did it happened & when? Was he on DACA before? Your's is a little tougher since you did hit government property. Alex's out come (which I hope is good) gives hope to others if he is approved. Even though my DUI was way before DACA existed I did get denied the first time but was accepted the next time. If they didn't have my file before they sure have it now. I'm worry that my replacement work permit will not get accepted & if it does get accepted I'm worried that my renewal will get denied even with my expunged DUI It's case by case -

This is the problem I see Jessica. Before DACA existed I had a DUI it's been about 10 years now. I was denied the first time around but was accepted the second time around with an "Expunged" DUI. Now, you guys had DACA before & obtained a DUI while on it. That's the thing that worries me. With this new administration they made it clear if anyone with DACA get's in trouble you're out of here if they found out let's say by the police or what not but under the USCIS they will not give out info unless it's something really big. I wish us all luck. -

Yazz33 do it ASAP. Did it mention anything about deportation because you were denied? I talked to a Lawyer about an expire work permit. She said the problem would be with the employee if he or she was to ask for new permit if your's is expire. They could fire you. -

Daniel I already posted a thread on here about that. You will have pay again & fill out the work permit form again & fill out replacement card on top. You will then take another biometrics and have to wait again

Yazz33 It took a month. I did it myself. I live in California. I went to the court asked how to expunged it, they gave me the paper work. I only took about 30 minutes to get everything ready. I waited then I had to pay about 75$ you can fill out a fee waiver. Damn Lori I'm so sorry.I hope you do get approved. I hope everything works out. Please keep us posted. I was concern the first time i got rejected because on the paper it did say USCIS can do that if they wanted too. The second time with an expunged DUI I was approved so I hope that happens to you too. No I'm still waiting for it. I'm thinking in the next 2 months I'll have an answer. -

Yazz33 They asked me For RFE the first time I tried to applied without an expunged DUI. My case was rejected! The second time around I expunged my DUI & my case was accepted. Lori Is this your first time applying & do you have a DUI This is my friends second time applying for DACA the first time he was approve with an expunged DUI. He send the renewal last month. Mr. DUI I wish you luck bud DUI's are considered deportations. I hope your case gets approved. My DUI was before I sent my DACA. I was rejected because of it,then I expunged my DUI and was accepted. Now your story is different. You got your DUI while you had DACA I don't know how they feel about that. -

Alex my friend also got a DUI a while back he expunged his DUI sent his package & was accept it. He is now renewing his DACA I'm curious to know if everything goes smoothly gain. Do keep us updated. -
You need to pay the the $465 I don't know if it went up. Send copies of your original 821D and fill out your 765 make sure to fill out replacement on top

Yes a DWI will disqualify you. As I was disqualify the first time. The second time I did qualify because I had my DUI expunged. -
I didn't hire an immigration lawyer this time. I sent the copies of my old paper with my lawyers signature (once again it was just copies) so not her actual signature. Now I think that worked because I did receive a receipt for biometrics. It's been 90 days it's still pending. ^^^^^ REPLACEMENT WORK PERMIT. FOR THE ACTAUL DACA PACKAGE The first time I sent all the paper work by myself with no expunged DUI it got rejected. The second time I expunged my DUI payed a lawyer got accepted.

Olivia B give us your status on your DACA I'm sorry for replying late. Lori. I'm really happy you didn't get deported because a DUI or anything at the moment equals deportation. Please keep us updated with your DACA to see if you got approved,I hope you do. I'm scare for myself & else. This is the only country I know... I'm still waiting for my Work Permit since the post office lost it. I had to pay again & take another biometrics so now it's a waiting game again. I think if they do send me one then my expunge DUI is not going to be a problem for renewal I hope. -

Of course. I have not yet received my replacement card. I was told I need to wait 30 days. The paper you need to send is simple Form I-765 make sure to check renewal on top. Form I-765 Worksheet. I had copies with my lawyers signature on the bottom. So I just sent those. If I didn't have copies with her signature I would of signed them and checked that I prepared them.

The best thing to do is get married & apply for residency. Talk to a immigration lawyer not a notary. If the process goes smoothly it's a couple of months for you to receive a work permit. Now for your question about inspection. I was told by a lawyer that it does, but once again get an experience lawyer. -
The information is receive is the following: If you are ever detained by any ICE agent of any kind. Don't ever sign anything until you have a lawyer. Some cases take years to process. Illegal or legal you have rights. & importantly we don't know what's going to happen until it does happen,.

Not yet. I did pay $465 & checked "Replacement Card" on the I-765 work paper. I have a new Biometrics Appointment this Wednesday.

Valeria if someone did report you guys (who ever it was they were assholes) You need to talk to an immigration specialist ASAP. You should not have sign the voluntary deportation instead tried to get a lawyer but what's done it's done.
