You can not appeal a decision unless there was a mistake from USCIS. Being able to re-apply will depend on the reason for denial. For example, if they denied you for insufficient evidence, you can apply again if you can get more evidence.

I think a lot of those denials were from people who knew they didn't qualify and just wanted to try it, or people who weren't completely aware of all of the rules and requirements and they applied without knowing they didn't qualify. A lot of them could also be people who just couldn't find enough evidence and sent their applications incomplete and couldn't respond to the RFEs with proper evidence.

Of course. They state what evidence they want to see and they give you a list of acceptable documents you can send in to fulfill their request.

You don't need to call them to do an e-request. An e-request is done on the USCIS website. Try to do one and see if it gives you the right options for the RFE. https://egov.uscis.gov/e-request/Case.do

El e-mail que pusiste en la aplicacion G-1145 solo era para notificarte al principio que recibieron tu aplicacion. Despues de eso ya no te mandan mas e-mails, solamente cuando haces una cuenta en la pagina de USCIS.

Even though you applied the same day, you all have different cases most likely being handled by different people. The evidence will be different, the time for the background check to be done will be different, the background check results will be different, your cases probably won't stay together or be approved together just because you're family.

Are you sure you're entering the right number? Your case status should show up by the time you get the two Receipt letters in the mail. If it doesn't show up by then, it could be that you won't be able to see your status until there is an update to your case, which will be until you're either approved, RFE, name change, etc.

I doubt that was the reason it took so long. I think that your application wasn't checked until recently and they found out you were missing the worksheet so they sent you an RFE for it.

Approved For I821 But I765 Still Under Review?

Most people get their I-765 approved first, which means that the I-821D is surely to be approved since you don't qualify for an EAD without DACA. In this case, your I-821D was approved first and you already got the approval letter in the mail, which can only mean that for some reason your I-765 needs further review. USCIS has a 90 day processing time for the I-765. You're going to have to wait until you hear a response. -

Basically an RFE. Although, it's asking for initial evidence, so something that you might have missed sending in initially like a photo ID, birth certificate, diploma. Did you forget something?

I edited my post. USCIS director Alejandro Mayorkas did state in a stakeholders meeting that you can re-apply if you can overcome the denial with new evidence. For example, those people who were being charged for bank statements and decided not to pay the bank for them and sent in their applications with insufficient evidence for the continuous residence and were denied because of it, they are able to re-apply and this time they can send the bank statements as additional evidence. They can't re-open that denied case and send in new evidence. They would have to start over again with a new case.

Yeah, you can't appeal or file a motion to reconsider, which means that if the case was denied it can't be re-opened unless it was a mistake by USCIS. USCIS doesn't state anywhere that you can't submit a new application. If you were denied for insufficient evidence and later on you find more evidence that you forgot to send the first time, there is nothing stopping you from re-applying again. An RFE is the abbreviation for a Request For Evidence. If the person looking over your case feels that you didn't submit enough evidence, for example, not enough proof of continuous residence for a certain year or time frame, or if you forgot to submit a necessary document like a photo ID, Birth Certificate etc. He will send you a Request For Evidence letter explaining what documents he wants to see or are missing from your application.

It sucks that your applications were denied, but that doesn't mean all is lost. If you were denied for insufficient evidence then that means that you still qualify for DACA and you can re-apply if you can gather more evidence.
