You just have to be in school on the date that you submit your application. -
The reason that it got stuck in my head is because I have read on some sites that a "threat to public safety" could be considered as a police officer questioning you about gang activity. That is why I was worried that it might show up when USCIS runs the background and criminal checks. Even though I called the Police Department and they couldn't find anything on my name, it's still in the back of my head.

I'm not sure, one of the requirements is this: Not have lawful immigration status on June 15, 2012. This means you must have entered the U.S. without papers before June 15, 2012, or, if you entered lawfully, your lawful immigration status must have expired as of June 15, 2012. What is your current immigration status? If you are legally allowed to be here, then I don't think you can apply. -

On the first part, you fill it out how it is on your birth certificate. Once you go down a bit it will ask you what other names you have used. There you can put your name that you use. -

For California you need a social security number and you need to verify your birth date and legal presence. I'm not sure if the EAD can be used to verify legal presence though.

I was afraid you would say that. About 4-5 years ago I was in front of my house washing my dad's truck minding my own business. In that same street lived a guy that used to go to the same high school that I attended. He was walking down the street and he saw me and he stopped to talk. The problem was that he had a gang related shirt on. About 2 minutes later, we saw an unmarked police car coming down the street, I immediately told this guy to take off his shirt or the officer would question him about it. He didn't listen. The officer parked in front of us and called him over, about 30 seconds later he called me over and asked me about the guy's shirt. I told the officer that I had warned him to take if off and that he didn't listen, the officer then asked me for my name and D.O.B. He also asked me if I was attending school and what grade I was attending and If I was going to graduate. The officer then left. I didn't think much about it at the time, but now, that incident worries me. I have since then moved out of that house and city and haven't spoken to that person since that incident. That has been the only time that I have had a run-in with the police. Today I called that city's police department and I explained my situation and asked them if they can run a local search of my name and D.O.B and the lady there told me that there was nothing showing up. Do you think I am free to apply?

Yes, photos that place you inside the US. What I did was I took screenshots of my facebook account of check ins that I made before June 15 and and after and even of some from last year and I went into Paint and cut them out and pasted them all onto one sheet, then I just printed it out. I'm doing the same with some photos that are dated, I put about 9 of them on one sheet and I printed it out. Whatever proof you have, the more the better.

You need to prove that you are currently enrolled in school.

You don't have to submit proof that you were here exactly on June 15th. You can submit proof that you were here in the US shortly before June 15th, and shortly after. For example, any pictures that place you here before June 15, e-mails you might have sent out or received, you can even check your facebook account if you have one and check if you checked in anywhere here in the US close to June 15th.

Each state has it's own laws and can change them. I'm not sure but hopefully everyone in California can get one.

My passport is expired can I still fill out the applications?

Go to the consulate and get any other form of ID that they can give you, I don't know if you are Mexican, but the Mexican one is called Matricula Consular, you can use that to prove your identity since you need to present your original birth certificate to obtain one. -
If you have been living here since you came with a different name other than your original one, that's going to be a problem. You basically don't have an identity. You will need to provide documents to prove your identity and prove that you have lived and studied here. A birth certificate, a passport, a matricula, transcripts, school records, if those stuff aren't under your name, you have no proof. Still, talk to an attorney and see what he has to say.

There's 3 forms, I-821D, I-765 and I-765WS Worksheet. There is also an optional one, form G-1145, that one is filled out if you want USCIS to notify you by e-mail or text message, or both, when they have received your applications after you shipped them. http://www.uscis.gov...000082ca60aRCRD

If it does show up on the record, you would have to put "Yes" on Part 3 question 1 on the I-821d form and provide them with copies or arrest records, charging documents, dispositions (outcome), sentencing records, etc.

One of the rules also states "Entered without inspection before June 15, 2012, or his or her lawful immigration status expired as of June 15, 2012. So you said you weren't here on June 15, 2012 which is another one of the requirements, and you are also here lawfully which does not meet the requirement I stated that you must have unlawful status as of June 15, 2012. Your best bet would be to contact an immigration attorney in your area and see if he can give you free consultation over the phone.

It says Date of last attendance, Graduation, Receipt of GED, or completion. Since he is still in school, he would simply put the last date he attended high school. For example, if you fill and send the forms tomorrow Saturday the 25th, and if he went to school today on Friday, the last date of attendance would be on 08/24/2012

Country of Residence is the country in which you are currently residing. Country of Citizenship/Nationality is the country in which you were born. Question 15 asks, how did you enter the U.S? Did you use a B1/B2 visa? -
