Candy89 4 Posted December 31, 2012 I got anxious and checked my case online, and found out that on December 21st, they sent out a letter requesting either more information or evidence for my case. Has anyone been through this same situation?? I'm honestly losing hope since I really didn't have much to turn in (I have not been working or going to school for more than 3 years) therefore, I hope they're just wanting simple information. roadrunner11 167 Posted December 31, 2012 Candy I am guessing the letter will be getting to your mailbox this week. I hope everything works out for you. I would start gathering evidence for all five years to be safe but do not worry I too much because I have seen people get RFEs and still be approved after they send their additional evidence. pswa83 302 Posted December 31, 2012 usually the RFE letter will state what evidence USCIS wants. which makes it pretty easier so i would wait and see what the letter says and then go from there. remember that affidavits can be used in certain situations. pswa83 302 Posted January 31, 2013 In which situations can you use affidavits? this is what i found on the FAQ page for DACA on the USCIS website Q1: May I file affidavits as proof that I meet the guidelines for consideration of deferred action for childhood arrivals? A1: Affidavits generally will not be sufficient on their own to demonstrate that you meet the guidelines for USCIS to consider you for deferred action for childhood arrivals. However, affidavits may be used to support meeting the following guidelines only if the documentary evidence available to you is insufficient or lacking: A gap in the documentation demonstrating that you meet the five year continuous residence requirement; and A shortcoming in documentation with respect to the brief, casual and innocent departures during the five years of required continuous presence. If you submit affidavits related to the above criteria, you must submit two or more affidavits, sworn to or affirmed by people other than yourself, who have direct personal knowledge of the events and circumstances. Should USCIS determine that the affidavits are insufficient to overcome the unavailability or the lack of documentary evidence with respect to either of these guidelines, it will issue a Request for Evidence, indicating that further evidence must be submitted to demonstrate that you meet these guidelines. USCIS will not accept affidavits as proof of satisfying the following guidelines: You are currently in school, have graduated or obtained a certificate of completion from high school, have obtained a general education development certificate, or are an honorably discharged veteran from the Coast Guard or Armed Forces of the United States; You were physically present in the United States on June 15, 2012; You came to the United States before reaching your 16th birthday; You were under the age of 31 on June 15, 2012; and Your criminal history, if applicable. If the only evidence you submit to demonstrate you meet any of the above guidelines is an affidavit, USCIS will issue a Request for Evidence, indicating that you have not demonstrated that you meet these guidelines and that you must do so in order to demonstrate that you meet that guideline. latinagirl 46 Posted January 31, 2013 saramaravilla after the bios all you can do is wait. from the moment they received your application is going to take from 4 to 6 months until you either get approved, or they ask you for more evidence RFE also I heard of few very few people that they have send then a notice or letter to do their bios again, so after that all you can do is wait!! register online uscis.com and you can received notice but is not always up to date so you can check constantly or just check your regular mail because you can get a letter from them. good luck and if you can share center and dates. oh yes forgot to mention it all depends in which center your application is at some centers are fast and some are slow! good luck! Just wait , if you didn't sign up for any updates via txt messages or emai you won't receive anything. NOw all you can do is wait , or you can sign up for updates via txt or email.
