I was just reading your previous posts about your bf's RFE going to his attorney and the light bulb went on! I called them yesterday but the attorney was in court and the secretary wasn't there i told them to call me ASAP but they didn't! So after seeing your post I decided to call them again and BAM! They told me they received it on Saturday or monday!! It bothers me that they didn't let me know! But right now I need to work on getting the evidence together! So here is what happened the week that they sent the packet some idiot crashed into me!! Some people don't pay attention when changing lanes! So we called the police so we can do an insurance claim from there everything went downhill because obviously I don't have a drivers license I called my bf before the police came so they wouldn't take my car! But when the police knew I didn't have a license he put whatever he wanted on the police report he stated that it was my fault that I crashed into the car!!! There were cameras at that corner I wanted to take them to court soooo bad but I knew that I would only lose my time doing that! He gave me a ticket and sent me to court! When I went to court they sent me to get processed and there they took my finger prints and picture! Then I paid $350 and case closed! Now I need to go to the court house to get a certified court disposition! I'm going to send that and also the ticket, public defender info, diversion program paper which i paid 300 for so that in 2 yours they will take that charge from my record unless I get another charge, receipt of payment and I'm also thinking of sending the police report even though the police clearly lied! I suggest you get the police report as well; did you answer yes to the question about arrests on the app? For what you have written you were detained, so when you went for your bios it showed, the reason why they want the disposition letter is because the want to know what happened in court and what the "sentence" was ($350 no time or anything else), so if all this happened after you submitted your papers it's OK you just have to explain so and all the court doc will have dates to prove it, if it happened before it was sent you may say it was an honest mistake no big deal. Calidreamer 100 Posted February 20, 2013 BTW 13 years ago my bf was detained because he was out after curfew, was taken in for finger prints and picture, was picked up by mom one hr. later and was told he had to do community service...he tried closing the record like you said, but there was nothing under his name at all, but still shows when bios are done! Calidreamer 100 Posted February 20, 2013 did uscis require him to send something regarding about his arrest ? yes they did asked for the court disposition, but like I say there is nothing, nothing at all, so he got a certified latter saying exactly that there are no records; this however was sent with the packet, so when the RFE was received he went to the PD to get the report, but they only keep them for 7 years so again he got a letter saying that. "If you have been convicted of a felony offense, a significant misdemeanor offense, or three or more other misdemeanor offenses not occurring on the same date and not arising out of the same act, omission, or scheme of misconduct, or are otherwise deemed to pose a threat to national security or public safety, you will not be considered for deferred action under this process." * A significant misdemeanor is a misdemeanor as defined by federal law (specifically, one for which the maximum term of imprisonment authorized is one year or less but greater than five days) and: 1)Regardless of the sentence imposed, is an offense of domestic violence; sexual abuse or exploitation; burglary; unlawful possession or use of a firearm; drug distribution or trafficking; or, driving under the influence; or, 2)If not an offense listed above, is one for which the individual was sentenced to time in custody of more than 90 days. Those attorneys take their sweet time to send things I called and they havent send it yet I'll have to call tomorrow again to pressure them to send it! We will notify you by mail when we make a decision or if we need something from you. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use the processing time information on our website to estimate when this case will be done.
