tgif168 2 Posted March 14, 2013 Does anyone know someone that was been denied for DACA? What happends if you do not get DACA granted? 1 jerriarielle225 reacted to this
splif0clock 89 Posted March 14, 2013 It depends. If you have massive criminal record and USCIS finds you to be a public safety treat or national security treat , they would report you to ICE once they deny your application. On the other hand, for some odd reason they deny your app - just like these 2 ppl http://tinyurl.com/bukzhta - they will just issue you a denial letter, that would explain why they denied you. In all case scenario, If you have clean record or minor misdemeanor charges and satisfy DACA requirements, you shouldn't be pulling your hair because they are taking longer than the expected wait period. Relax and keep calm, our approval would come soon. 2 Dariela and Afrosana reacted to this
Rawf 336 Posted March 14, 2013 That's so sad to read! Not sure if they released the attorney information or if I just missed it. I would sue the attorney if it was her/his mistake.
splif0clock 89 Posted March 14, 2013 Indeed, the story is sad. The thing is, the applicants at some point signed the application so I don't think they would be eligible to sue the attorney. They could report the attorney to board of ethics but I am not sure if it meets the base for ethics review.
EL_Aviles 12 Posted March 14, 2013 she didnt say why they denied her, or what the letter said this is bs.
JoseG 383 Posted March 14, 2013 she didnt say why they denied her, or what the letter said this is bs. They were denied 2 days ago, so they probably don't have the letters yet. 2 Dariela and star28 reacted to this

No one knows you better than your own self to make changes to the application(s). =/ 2 star28 and snoop90044 reacted to this

pswa83 302 Posted March 15, 2013 traffic tickets will not affect the decision on your DACA. however, the possibility of you getting an RFE because of that is good. they may ask for the court papers or for copies of the tickets. also, once you are able to legally get your DL, you might not able to do so until those tickets are paid off. also, seeing how you havent paid them, i assume you didnt show up for court either? if i'm correct then, there could be a warrant out for your arrest. what i would do, if i were you, i would, if you can, go online and see if you can look at your cases online. if you can, it should say in the court minutes if there was a warrant issued for you. while waiting for a decision on your DACA, i would take care of the tickets and see about getting copies of them along with court records. pswa83 302 Posted March 15, 2013 DACA guideline state that if one is not granted DACA then one can not re-apply unless there has been an admin mistake on the part of USCIS. If USCIS Does Not Exercise Deferred Action in Your Case If USCIS decides not to defer action in your case, you cannot appeal the decision or file a motion to reopen or reconsider. USCIS will not review its discretionary determinations. USCIS will apply our policy guidance governing the referral of cases to U.S. Immigration and Customs Enforcement (ICE) and the issuance of Notices to Appear (NTA). Your case does not involve a criminal offense, fraud, or a threat to national security or public safety, your case will not be referred to ICE for purposes of removal proceedings except where DHS determines there are exceptional circumstances. For more detailed information on the applicable NTA policy visitwww.uscis.gov/NTA. Administrative Errors You may request a review using the Service Request Management Tool process if you met all of the process guidelines and you believe that your request was denied because of an administrative error. Examples of administrative errors include USCIS denying your request for deferred action because: USCIS believes you abandoned your case by not responding to a Request for Evidence (RFE) and you claim that you did respond to the RFE within the prescribed time; or USCIS mailed the RFE to the wrong address, even though you had submitted a Form AR-11, Change of Address, or changed your address online at www.uscis.gov before the issuance of the Request for Evidence. Osha 126 Posted March 15, 2013 I got 2 Tickets for driving without a license . I never paid them. do you guys think this will affect me if I apply for deferred action ? No. You were not arrested or booked, it won't affect your case, unless there's a warrant for your arrest.
gperez562 4 Posted March 15, 2013 I Appeared At court I just didn't pay it. Cops were assholes excuse my language. Ive gotten pulled over after that and they run my record and I guess they don't show in their system that I didn't pay cuz if it did I would of gotten arrested or something... You have nothing to worry about. Although, I find it weird how police can write tickets to undocumented individuals, how would that work exactly? If we're not in the government or police data base then how do they know if they are writing a ticket to the right person? Is like writing a ticket to a ghost. gperez562 4 Posted March 15, 2013 There just ass out here in cali. But tickets ive gotten have only been eighter for no license or ins n expired tags. No criminal record. I just want to be sure I can really apply cuz if I don't ill be reported with ICE .
pswa83 302 Posted March 15, 2013 even if you apply and get denied, they're not going to report you to ICE. you'll just be in the same situation you are now. no papers, no nothing.

jd_208 19 Posted March 15, 2013 Yeah no, dude dont even waste your money, your too hot. It clearly says that no more than 3 tickets, a friend of mine just got denied. He had a tps but he lost his licence due to 2 wreckless tickets, after that he got caught another 3 times driving without a licence. He waited 6 months for a denial. JoseG 383 Posted March 15, 2013 You can not appeal the decision or ask USCIS to review it, but you can still re-apply. Say for example you were denied because of an error on the application or you didn't have enough evidence the first time but you do now. Yeah no, dude dont even waste your money, your too hot. It clearly says that no more than 3 tickets, a friend of mine just got denied. He had a tps but he lost his licence due to 2 wreckless tickets, after that he got caught another 3 times driving without a licence. He waited 6 months for a denial. Reckless driving is not eve remotely the same as driving without a license. Reckless driving is considered a misdemeanor in most states, and can be punishable with jail time. If you are reckless driving, then you are putting other people in danger and could be considered a threat.

JoseG 383 Posted March 15, 2013 Just the 2 TIckets I didn't pay has me wondering if I should or not go thru with this. ummmmm geez You should be perfectly fine. Driving without a license tickets are considered minor traffic offenses by USCIS.
