Does Daca Allow Us To Establish Residency?

I recently applied to college in CA and was classified as an out of state student even though I've been living here for 5 years. I graduated from high school in TX 9 years ago and attended some college there too...so today I took the paperwork to be reclassified as a CA resident but was told my EAD does not allow me to establish residency and would have to pay out of state tuition even though I was able to prove I was physically here for more than a year.

Does this sound right or did I just get someone that didn't know what they were talking about?

This is what the college's website says:

applicants must be citizens of the United States or legal aliens with an immigration status which allows them to establish domicile according to the laws of California

The CA dream act is for those who graduated in CA High school only, as far as I know. Therefore, since you graduated in Texas, as an undocumented student, you dont qualify for in state tuituin cost.

Hmmm, I figured since I've been living in CA for 5 years that as soon as I was approved for DACA/Work Permit I would be able to apply as a in-state student...

So does that mean I have to wait a year after getting my work permit to be considered for in state tuition?

But even then you wont qualify because you did not graduated High School in California man.

If I was you, I would take a GED program in California and wait 1 year to qualify for in state tuition.

I would give it the try if possible.

i think if you can establish that you have lived in CA for a year, through utility bills or rent receipts then you can apply for in state tuition.

i would make an appt with an admission rep to find out your residency options as opposed to just talking to someone at the admission desk.

i know when i applied to college (back in 2004) i had to get the Dean of Admissions to sign off on my admissions even though i did graduate from a CA high school.

it might take a little extra work but if you can get CA residency for school then it will save you TONS. Good Luck!! :)
