Under 15 at the time you apply

I have contacted an attorney in regards to someone who is under 15 not being able apply, the attorney said that being under 15 at the time you apply is not a problem. I have also called immigration and the lady there advised that a child under 15 can still apply! Can someone please clarify!

I don't think there is anything in the guidelines that states a minimum age requirement to apply.

I know it says that you have to have come to the U.S under 16 and must be under 31 to apply, but nothing on the minimum age.

This has me puzzled...

On page 1 of the instructions for i-821D form it says that people who have not been in removal proceeding have to be 15 years or older, it is in the who may file section on number 1.

2 and 3 say people who are in removal proceeding under 15 can file it.

on General Instructions on the second sentence it says that if you are under 14 you need your parents signature and blah blah blah so this thing contradicts itself >_<

It was confirmed today in the teleconference that you must be 15 years old or older at the time of filing. The only way you can file if you are under 15 is if you are in removal proceedings.
