Veevee20 14 Posted April 25, 2013 I actually came across with the "new" advance parole form, and I say "new" because it still doesn't change anything! Yes DACA can ask for AP but it still not a guarantee you'll come back since most of us DACA have been here all our life's and accrued unlawful presence. It says DHS can revoke your AP if they want to which is totally frustrating! Why give us advance parole if its not a guarantee you'll get back with out a problem ? Although the guidelines are still being finalized for DACA travel document,but so far all I just see is change of words, And no guarantee DACA can get back hassle free. I hope they partner up with DHS and allow re-entry for all DACA. That really is fustrating because that's something a lot of us would like to do is travel to see family and so forth. From what I read, this takes away the danger of being barred 3 or 10 years from re-entry if you have been Unlawfully Present. Leaving the United States with anAdvance Parole Document is a “departure” from the United States for all purposes under the U.S. immigration laws except that it is not a “departure” solely for purposes of inadmissibility under INA section 212(a)(9)( (inadmissibility due to prior unlawful presence) About the part where DHS can revoke your Advance Parole, I find it interesting that it says this, (e) Termination of parole -- (1) Automatic . There's never a guarantee that you will be paroled into the U.S. because there are many factors that could make you inadmissible, but Unlawful Presence for us DACA approved will not be one of them anymore. One reason for inadmissibility upon return might be if you left the U.S. without Advance Parole after being Unlawfully Present in the U.S. for more than 180 days, but if you have not left since you first arrived to the U.S., there should be no issues. The reason why I've been digging about this is because I have a family member who has breast cancer and I will like to visit here, I just feared not being able to come back. Most of us DACA approved only have Unlawful Presence as our only inadmissibility, and this revision will make it so that when we leave with Advance Parole, it won't count as a departure from the United States, so we won't be subject to being barred for 3 or 10 years. If someone has had an order of deportation or ordered removed prior to obtaining DACA, they will need to reopen their case and obtain closure of their removal proceedings before they travel, or else their departure will result in them being considered deported.
