Will An Unpaid Traffic Ticket Disqualify Me For Daca

Recommended Posts

Hello everyone I hope that I can get some insight on this matter that is worrisome for me. I meet all the requirementa for Daca & am a couple of weeks away from sending my request for deferred action, however, I got a traffic ticket in 2011 that I failed to pay. Initially I went to court & set up a payment plan, later on I fell into financial trouble when the car shop that I worked at closed down and in result I was unable to keep paying the court fees, the ticket went into collections and is still unpaid. I'm worried that my request for deferred action will be denied because of my failure to pay. My question is that if I send my request for DACA will it be denied due to having that one unpaid ticket? I hope someone can give me some insight on this matter.

Thank You, Sincerely

Alex P.

i would talk to a lawyer if possible. the thing is is that if the ticket went into collections, more then likely the court might have issued a warrant for your arrest.

if you still have your tickets and court papers, include them in your DACA paperwork so that you dont get a RFE after you send in your application.

also, there are a few counties in CA, where you can go online and look at your court case online. if you can do this, then do it, print out what you can and then go to the lawyer.

i know minor traffic tickets will be overlooked in your DACA application but it will still come up on the background check.

if now you have a job and can start paying again, i would call the collections and ask if you can start making payments again. but like i said, get a lawyer and ask them about it.

That's the thing there is no warrant for my arrest, I've used resources available to me such as warrant lookup through the San  Diego sheriffs website and there is nothing in my name

It seems to me like there would be two possible outcomes, have the ticket go to collections or have a bench warrant issued out on you or maybe both. Since you say that you can not find a warrant and that the ticket went into collections, it seems to me like the worse that can happen is it affects your credit and you can lose your license, if that's what really happened.

I know hardly anything about this sort of stuff, but that's just my take on it. An easy way to find out would be to call the court and see if there is a warrant issued? If not, you would be free to apply.
