Visa Overstays

Hi guys !!

 

I have a question for all the people who overstayed their visas and have been approved.

How long did it take for your approval if you sent in all the correct evidence.

Just wondering if overstays are processed faster than others who didn't enter on visa.

The processing times are not absolute and each case is unique in how long it takes to approve/deny. Some cases were approved in a couple months others are in the dreaded 9 month period.

I got here on a visa in 1999. Here's my current timeline

Date Application Sent: 2-19-13
Lockbox: Chicago
Mail Method: Lawyer-Usps
Received Date:2-22-13
Date of Acceptance e-mail/text:2-24-13
Service Center: Nebraska
Date of Biometrics:3-20-13 (Walk-In) 3-10-13
Date of EAD Approval:---

In my opinion, your manner of entry has little effect on your case. If two people arrived here at the age of 8 years old, one came with a VISA and the other came illegally, hypothetically speaking, they would both have been enrolled in elementary school at the same time, so they would both have proof that they have been here since that age, so the manner of entry doesn't even matter in that situation.

 

The only way that coming with a VISA would help is if you have two people that arrived shortly before their 16th birthday, one with a VISA and another illegally. The one with the VISA would be able to prove exactly when they arrived, so there would be no problem in proving that he arrived before turning 16. The person that came illegally would have a difficult time proving that requirement, if he didn't sign up for school or start working immediately before turning 16.

 

Other than that, I think your manner of entry has little effect on your case.
