Left Usa 2007, Obtained Visa B-2, Residing In The Us With Permit Is Dream Act Still Possible?

Question being: Can I still be considered for the dream act if I left the US in 2007 and came back in 2011with a Visa B-2?

 

I graduated in Mexico with an Engineering Career, now I'm wondering if it ever be possible to be eligible.

 

I'm 28 currently, studied since elementary 4th grade up until third year in a community college.

 

Except I got my tourist visa from the US in 2011 December.

There currently isn't a Dream Act.

 

If you mean Deferred Action for Childhood Arrivals (DACA), then I don't believe you're eligible.

 

To apply for DACA, you must meet 7 guidelines, one of them being that you must have continuously resided within the U.S. since June 15, 2007 up until the time of filing your application. You say you left in 2007 and came back in 2011, that is a 4 year gap in the continuous residence guideline, so you would be denied. Another requirement is to have been here in the U.S on June 15, 2007, so I don't know if you were or not. 

 

Is your VISA expired and have you renewed the I-94 since you obtained the first one?

i dont think you'll be able to apply because you left the US in 2007 and were gone till 2011. one of the requirements, and it's important, is to prove residency in the US from june 2007 to june 2012 (f not later)

 

since you were gone for the majority of that time, you will be denied
