JoseG 383 Posted September 6, 2013 The guidelines state that you must have entered the United States before reaching your 16th birthday. You say you first came at the age of 3 months, then left in 1987 and didn't come back until 2001, that tells me that you were here in the U.S. for about 2 years, then left for 14 years before you came back again. That 14 year gap pretty much makes your initial entry at 3 months irrelevant. The second time you entered you were already 16, so that means that you would not qualify for DACA. cheated 20 Posted September 6, 2013 i wonder if they'd request more proof if he says he never left?
Theresa 63 Posted September 7, 2013 I don't think anyone will buy the fact that he never went to school for 16 years plus not having evidence on continuous presence and proof of being here before his 16th birthday. But the only piece needed is being present before his 16th birthday. Almost made it :/.
