Might This Be A Possible Bump On Daca Road? Please Help!

Hello dreamers.. 

Well i've been posting lately to get some insight from you guys that know the process a little better than me. 

Anyhoo.. well today my husband and I went to go get his school transcripts (elementary, middle, and high)

come to find out that my mother in law took him out of the country and on his school records it says that his mom transferred him out during the 5th grade which means he did the 6th grade in mexico came back in (illegally) and did 7th grade all the way through 2 years at California State University. 

 

is this going to affect him? please let me know. 

 

and his mom took him out of the country because his parents were separating and their divorce wasn't amicable so she decided to take all 3 kids out of the country but unfortunately only my husband is the one that doesn't have his papers, the other 2 were born here. thanks for your advice.

I think he'll be fine. You say he came back in 7th grade and stayed. I doubt he was age 16 yet. As long as he came to the USA before reaching his 16th birthday, he'll satisfy that requirement. Here are the other requirements by USCIS:

 

 

Guidelines

You may request consideration of deferred action for childhood arrivals if you:   

  1. Were under the age of 31 as of June 15, 2012;
  2. Came to the United States before reaching your 16th birthday;
  3. Have continuously resided in the United States since June 15, 2007, up to the present time;  
  4. Were physically present in the United States on June 15, 2012, and at the time of making your request for consideration of deferred action with USCIS;
  5. Entered without inspection before June 15, 2012, or your lawful immigration status expired as of June 15, 2012;
  6. Are currently in school, have graduated or obtained a certificate of completion from high school, have obtained a general education development (GED) certificate, or are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States; and
  7. Have not been convicted of a felony, significant misdemeanor, three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety.

ok yes that's what I assumed. 

you're correct, he is 25 years of age right now so when he left 6th grade he was 12 years old, 13 when he came back.

ok thanks guys! i was kind of losing hope but thanks goodness you guys told me it should be good. :)
will be sending forms this Monday :) cannot wait to post hubby's timeline and at the end have it say APPROVED.
