asuarez1985 7 Posted September 11, 2013 Hello, On Thursday Sept. 5 I received an email from USCIS requesting more evidence on my case. The next day I called their offices and I was told that I should be receiving a form in the mail within 15 days, and that I should fill out the form and follow the instructions that will indicate what evidence or information they need to fully evaluate my application. I know many of you have received a "RFE" and I wanted to know what exactly is that they will ask me for so I can start preparing myself in gathering whatever evidence is required. Many people have told me that they will ask me for an income report, some notarized letters from people that have known me for many years, ect. What form will they be sending me? is it the I-797E? Also how long will I have to wait, after I send the form back, to get a decision on my case? I am going on 10 months now and I would appreciate any help I can get regarding this matter. Thanks. JoseG 383 Posted September 11, 2013 No one knows what they will request since USCIS doesn't just send out RFEs for one certain thing. There are 7 requirements for DACA, which are these; Were under the age of 31 as of June 15, 2012; Came to the United States before reaching your 16th birthday; Have continuously resided in the United States since June 15, 2007, up to the present time; Were physically present in the United States on June 15, 2012, and at the time of making your request for consideration of deferred action with USCIS; Entered without inspection before June 15, 2012, or your lawful immigration status expired as of June 15, 2012; Are currently in school, have graduated or obtained a certificate of completion from high school, have obtained a general education development (GED) certificate, or are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States; and Have not been convicted of a felony, significant misdemeanor, three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety. They can request extra evidence on any of those things and even some other things not listed. You have to wait until you receive the letter to know what it is that they want you to send. After you send back the requested evidence, you should receive a response within 60 days, although some people have waited longer than that. Share this post Link to post Share on other sites
