Daca Denied, I Need Some Clear Answers.

So after a year of waiting, I got a RFE needing to prove from Jan to June 15 of 2012 three weeks later I get denied, I just got my letter today, and I got denied, on the letter says because "You have not established that you were in an unlawful immigration status in the United States on June 15, 2012" What does that even means? That was the only reason I got denied, nothing else.

 

But it too it also says that I did established that I was present in the United States on June 15, 2012. What is the differences? Where did I go wrong? is there anything else I can do about this? Is there still hope for my case?

To me that seems like, you had some kind of status (Visa, etc) that hadn't expired yet as of June 15th, 2012 or somehow you were not able to prove you were Undocumented basically.Because if they wanted proof of you being here, they would have said Physically proven you were here on [Date] I would think.

 

What's your situation like? As in, did you have any kind of status at all during 2012? If not.. then they must mean proof that you were in the US during that time frame. They needed Bills/Documents anything placing your name with a date inbetween Jan-June of 2012. 

If you don't think they made an error, the only thing left to do is to reapply, pay the fee again and wait. Its only recommended that you reapply if you find new evidence, or you'll probably get another RFE again.

 

If you did think they made an error and you provided what you think was sufficient proof, then you can request to have someone look over your case again.. just to see if they made a mistake.

My Visa expired way back in 2002 I did not had any status during 2012

Did you send evidence to show that your VISA expired in 2002, like for example, a copy of the VISA or I-94? If so, I would definitely call USCIS and ask to speak to an immigration officer and explain to him/her that you were issued an RFE for one thing and that you sent in those requested items, but you were denied for something else, which was not listed in the RFE.

My mother lost her bag with hers and my visa long time ago, so I no longer have that visa with me.

 

And I will get a lawyer see what he has to say.

Does that mean that you didn't send a copy of your expired VISA, nor any other evidence showing that you are currently overstayed?

Nope I didn't sent any copy of my expired visa. I believe it wouldn't actually matters anymore.

You didn't give them enough prood

dont swet it i applied in march and still waiting   u bearly applie din august u not even in ur 6 month period ... and besides ur case is in vermont    vermont is the slowest one!
