Am I Eligible For The Dream Act?

Hi

 

I came over to US legally on tourist visa in 1999 and at the day of my entrance I was 16 years 8 months 15 days old.

I've been here ever since after overstaying it. Graduated HS and 4yr college during the years. Are there any exemptions as far as age requirement in the Dream Act?

 

I cover all of the other reqs except the age which is off by 8 months 15 days. I would like to know if it's possible to still get accepted or if anyone in similar situation got their forms approved/declined. Would like to avoid paying filing fees just to find out the application getting rejected.

 

Any info is highly appreciated and thank you in advance.

Very admirable but unfortunately, they consider that ineligible for DACA. You had to be 15 years old. :(. Hopefully dream act or immigration reform will pass soon. You have come a long ways with college and everything, hopefully soon something greater and better will come and you'll be one of the people they would want to approve become legal because of the formal education you have achieved.

dream chaser you should give it a shot, make some fake invoices saying you were here before you were 15 its not like they are going to go back and check, I faked a few invoices including the jun 15 date cus I didn't have any proof now, I think you d be alright you should try it really, money comes and goes

Hi. I have a question. I came here when I was 11 and am now 21. I had a couple run ins with the law at 16 and got 2 possession of firearms charges, but they were not counted as felonies. I got juvenile court and neither one of the instances did I serve more than a year in a correctional faciliry.i have my ged, I am married to a usc, I go to church, and have had a clear record ever since. Does anyone think ill be approved. Pls reply. Thanks

Nah I think your fucked but who knows give it a shot . I did with a fucken felony and got denied smh

All I did was fucken scratch a car and they said it would cost more than 750 to repair so that's why I got a felony lol. Bs.

Thanks. I figured that the extra couple months past the deadline would be a showstopper in getting approved under DACA. Hopefully something will happen in the near future. Was hoping that the pres would lax the DACA reqs in todays speech. No dice :/

I'd rather avoid doing fraudulent activities, one because i'd feel bad doing so and two i'm on record with uscis so i'd be basically digging a hole under me.

Yes i do have I-94 and i also forgot to mention that I'm lucky enough to have filed I-130 through my family however the wait time is pretty long and I was just looking to see if I could at least get some sort of peace of mind that comes with DACA until the I-130 is approved. A marriage to USC is also an option. Thanks

They should have denied you for FRAUD and referred you to ICE to be deported. ! Don't In courage people to do fraud! They will go back and check everytime you renew and I hope you get punished to the full extent of the law for fraud. People like you make me sick! Obey the rules like everyone else!

Yes it's a tough spot to be in indeed. The "born prior to June 15, 1981" means that DACA was extended to people who came here before age of 16 but were older than 31 at the time of DACA making them ineligible. Now with the new rule in place individuals who came here before age of 16 and are over age of 31 can also apply for DACA. Hope that makes it clear.

 

So that still is of no help to your Mrs and myself. As far as the ban goes i'd think that if she was entering as UK citizen then the ban would be waived, plus there's even an waiver application that you can try to submitt to get the ban lifted.
