ViK 7 Posted March 6, 2017 Yazz33 It took a month. I did it myself. I live in California. I went to the court asked how to expunged it, they gave me the paper work. I only took about 30 minutes to get everything ready. I waited then I had to pay about 75$ you can fill out a fee waiver. Damn Lori I'm so sorry.I hope you do get approved. I hope everything works out. Please keep us posted. I was concern the first time i got rejected because on the paper it did say USCIS can do that if they wanted too. The second time with an expunged DUI I was approved so I hope that happens to you too. No I'm still waiting for it. alex007 1 Posted March 15, 2017 Hi guys i just received a email from USCIS. I send my renewal with my expunge DUI and was delivered 3/6/17 at the Phoenix Facility . On the email it states " Your case has been accepted and routed to the USCIS Nebraska Service Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number IOEXXXXXXXX. I read info online that the Nebraska center takes longer for processing DACA Renewals. Also does any of your cases have been rerouted? Thanks guys. Share this post Link to post Share on other sites
Guest Yazz33 Posted March 16, 2017 Vik Thank you for the information, my case was rejected. Now I will get my dui expunged and reapply and hopefully I get as lucky as you and they accept it. I also have another question, my working permit is expired now but my job hasn't told me anything. Should I let them know? Has anyone worked with expire working permit? ViK 7 Posted March 16, 2017 Yazz33 do it ASAP. Did it mention anything about deportation because you were denied? I talked to a Lawyer about an expire work permit. alex007 1 Posted March 16, 2017 HI ViK I did had DACA when it first came out but than got a DUI and waited for the expungement. I just send my renewal including my expungement, and received the email that it was accepted by USCIS. I have not been granted DACA yet. My application is just been routed to Nebraska facility for processing i am waiting for the fingerprinting appointment. But i do hope i can be granted DACA once again. So I believe I can't get it expunged until I complete probation or it gets reduced early. Alex007 I applied oct 24 2016 and it was denied march 5th 2017. Please keep us updated on your case Alex. alex007 1 Posted March 23, 2017 Hi Yazz33 Thx for the info. My fingerprint appointment has been schedule I am waiting for the official notice in the mail. Also I had a year left on probation till January 2018 but I talked to my lawyer that handle my DUI case and he was able to to file a motion for early termination on my probation and the judge approve it on December 5th 2016. After that he file for my expungement and that was approved in Jan 17 2017. My DUI happened in CA. Share this post Link to post Share on other sites

alex007 1 Posted March 23, 2017 Jessica23 My dui attorney advice me first to pay all fines, and complete the dui classes and everything asked by the court. Than to wait at least 2 years of the 3 years of my probation. He stated that I would have a better chance the judge to grand my early trrmination of probation after completing 2 years and have nothing else in my record. When he presented my case he explain to the judge why I need my probation to be terminated. My attorney explain that i was graduating from my local university and need it for job related purposes. Because its coming up and what you are saying is to apply then tell them all that happened because thats what i was trying to do but i keep talking to attorney's and they say dont apply. alex007 1 Posted March 23, 2017 Your attorney say not to apply for your early probation termination or DACA? Yes I was arrested and booked to my county jail and release the same night. The next day I contacted an attorney to fight my DUI case. I still got convicted of misdamenor DUI. I had to do community service hours and didn't have to do the classes just pay the fine. With applying for my DACA renewal. I contacted a immigration attorney and she looked at my DUI case and stated that I must expunge it before I can reapply for DACA. One lady said it doesnt matter if i wait to reapply immigration doesn't care i can wait till i expunge it and then reapply dont matter if i waited. Thats what she said. But idk if thats true. ViK 7 Posted March 24, 2017 This is the problem I see Jessica. Before DACA existed I had a DUI it's been about 10 years now. I was denied the first time around but was accepted the second time around with an "Expunged" DUI. Now, you guys had DACA before & obtained a DUI while on it. That's the thing that worries me. With this new administration they made it clear if anyone with DACA get's in trouble you're out of here if they found out let's say by the police or what not but under the USCIS they will not give out info unless it's something really big. Guest jessica23 Posted March 24, 2017 thank u vick i just spoke to this guy that had been arrested he had a dui he applied he got denied 6 months later got picked up what i was so scared of, i just thought because i let them know n wasnt hiding anything i would be ok but no he got taken he got out on bail someway got it dropped waiting for an approval i guess but i dont think its anything near mine because i had a hit in run that day too but hit to gov property a sign with a 24% so i think ill just try to get it expunged its the only think i thin i can do what do u guys thnk i was just scared that if i dont apply they will look for me he adviced not to apply with dui on rec Share this post Link to post Share on other sites
alex007 1 Posted March 24, 2017 Hi Jessica23, I exactly know how you feel about getting a DUI. Also if my case gets rejected i am scare that i can get deported. But at the end of the day my arrest record is already on their database so basically ICE have access to that info at any time they want. My only option is to renew in hopes they can grant me DACA once again. Where you convicted of a misdemeanor DUI? You might want to look up attorneys in your area that specialize in expungements. The first thing is to pay all fines and complete everything that courts asked you to do fines/dui classes and probation. You mention that you are under probation and currently paying your fines. You can continue paying your fines until your probation is over by next year. Before you can apply for your expungement all fines need to be paid in full. Vik mention in a early post that he expunge his own record, but he already had paid all his fines, dui classes and had completed his probation. Than he was able to apply for his expungement. If you want to expunge your record right now you would need to pay your fines first. Than file the motion for an early termination for probation and once the judge approves it. You can file for your expungement. This is the option i did but i had to hire an attorney to this for me. Share this post Link to post Share on other sites
ViK 7 Posted March 24, 2017 Jessica, This guy got picked up by ICE after he got denied for DACA? Was a simple DUI misdemeanor & where did it happened & when? Was he on DACA before? Your's is a little tougher since you did hit government property. Alex's out come (which I hope is good) gives hope to others if he is approved. Even though my DUI was way before DACA existed I did get denied the first time but was accepted the next time. If they didn't have my file before they sure have it now. I'm worry that my replacement work permit will not get accepted & if it does get accepted I'm worried that my renewal will get denied even with my expunged DUI It's case by case Share this post Link to post Share on other sites
