Daca with expunged misdemeanor

Hey guys im a new to this. I applied to the DACA program in October  of 2016 *thinking hillary would win*. I currently get a one year work permit thru other means but daca is great beacuse you get for 2 years and i have a sick grandmother ive never met and i heard you can get advanced parole thru it. Well ill keep this short. In 2014 i got a misdemeanor for target shooting 150 ft from a road. I was with a friend and my dad thats a US citizen and it was his rifle he owns legally. I got a 1 year probabtion with no jail time and was never even taken in. After 6 months i asked the judge with a lawyer to dissmiss/expunge the charge and the judge approved it and my probation was only 6 months. I then went to see a immigration attorneyand he said i think you have a great chance in getting daca approved even with a firearms misdemeanor beacuse i work as a firefighter/emt and the charge was expunged. We put a packet together with my schooling and acedemies ive attended with letter of good moral character . Well im still waiting. Curious if anyone else is in the same boat and got approved with a expunged firearms charge.? Asumming they look at that as a firearms charge.

A DUI is considered a * Significant Misdemeanor" I was rejected the first time but was accepted after with Expunge DUI

How long ago did you talk to this lawyer? Also, you should contact him again and ask him how much experience he has with cases like yours with people that have expunged misdemeanors. Your charge can fall under " bad moral character " since it involves firearms, and with the new memos USCIS can refer your charges to ICE, so it's really important that you seek an experience lawyer that deals with DACA and DACA's that have past charges.

 We applied in October of last year and like everyone we thought hillary would win . He does have a good amount of successful daca cases but none were fire arms cases. he looked at my charge and said hed never even heard of it and it looked at the circumstances and said we have a great shot. F&g 3004.a shooting a firearm or bow 150ft from a road or out building. Was the charge. Its a fish and game charge. It was about a hour outside of town in a designated shooting area we just were to close to the road. I did my figner prints in NOV and the tough part no id The wait. Ill keep you guys updated on what happens. Im in CA and the case is in CA.

Ok since you filed earlier that's good, because that means that most likely they did your background check before the new memos. I think you should have an update soon, does it say anything at the USCIS website when you put in your case status number? Also keep in mind that you can call them if they have taken longer than 3-4 months.

No new updates yet. Just says they received my case and they got my fingerprints. But no change since NOV .

Try this number to check on your case status, maybe they can tell you something. Phone: One way to check the status of your pending case is to call USCIS at 1-800-375-5283. You can call them whether or not you have a receipt number. Depending on how busy they are, you can be placed on hold anywhere from two minutes to two hours.
