Olga 0 Posted November 8, 2012 hi my boyfriend enter the application and we still waiting our plan is to get married next year so my question is if he gets accepted and we get married next year and if we apply to get his paper does he has to still go out of the country or with the work permit he could stay in the usa while he gets his green card?? JoseG 383 Posted November 8, 2012 This isn't the Dream Act, this is Deferred Action for Childhood Arrivals (DACA) The Dream Act provides us with a pathway to Citizenship, DACA doesn't. DACA and the work permit alone would not make it any easier or harder to adjust your status. If he entered with a VISA, he wouldn't need to go outside of the U.S. and he would be able to adjust his status without a problem. If entered EWI (crossed the border illegally) He would have to leave the U.S. unlesss they are covered under 245i, and would probably not be able to re-enter for 3/10 years. There was a case recently where someone who came EWI but had (Temporary Protected Status) TPS traveled outside of the United States with Advance Parole, then when they tried to adjust their status, that person didn't need to travel outside of the country anymore because they were let legally back into the country through Advance Parole.
