MISDEMEANOR QUESTIONS PUHLEES

Hi I'm a korean american living in NYC. I was caught with weed twice and a charge for trespassing to play basketball. These all happened before i turned 18 and i have also attended my court dates and all the necessary requirements the judge had asked for. now my question is, how will this affect my i-765 application? plsssss get back asapppppppp

One of the requirements is that you have not been convicted of a felony, significant misdemeanor, three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety. So sounds to me you have 3 misdemeanors. Most people can go to a court and have their records expunged by a judge of you have "small" misdemeanors. Though the trespassing is childish and innocent if you explain it in your application.

So, in my opinion it might be better for you to talk to a lawyer, Or maybe you hear from other forum members that have experience ;)

i mean, im pretty sure i didnt get any significant misdemeanors and i know all this information i was wondering if anyone had more information about what kind of acts classify as misdemeanors/significant mis. and if such violations would remain on my record?

HI,

Currently, anyone caught with 25 grams or less of weed in their own private possession is subject to a violation in the sate of New York. If they have it in public view or are using it, they would be subject to a class B misdemeanor, which could mean up to 90 days in jail and a permanent mark on their record.

Now, I would recommend contacting an attorney in your case.

buttttttttttt the thing is, they transfered my case to youth court in nyc and then youth court gave me community service and sent back my file to the original court saying i did what i had to do and that my file should be sealed. or something of that manner
