Rena 2 Posted November 16, 2012 Hello all, first i must apologize for any typos or bad grammar (i am writing from my phone ). My husband and I have been legally married for over three years now and we have just received his DACA approval letter and now we wait for the EAD. Once we receive the EAD we are going to get his social security number and a drivers license. At that point in time since he has been married to me (a us citizen), can i file for him to adjust his status here without having to leave the country? Thanks! taramo35 27 Posted November 16, 2012 I'm in ur same boat but I'm the alien here . I talked to a few lawyers and they all told me that its the same thing . It doesn't help in any way . But I also heard that things might change and he could get his waver approved before leaving the country . Which means his not going to be out of the country for months and he's return to the us would be a for sure thing. I think he should wait... Aled 118 Posted November 16, 2012 HI Rena, if being approved for DACA and marriage was perhaps an easy option to acquire residency or citizenship many would be looking for a citizen to marry. DACA itself does not give a path to citizenship. Now if you are granted DACA and marry a USC, you will only be granted permanent residency if and only you entered the country legally. Rena 2 Posted November 16, 2012 Thank you for both of you replying. My mom is friends with this lawyer and i had called him and asked him several questions. He had given me three very bold statements which i have/had doubts over since they were high claims. His statements were -The deferred act is coming out - he knew when and the exact price and how to file well before i have even read about it on the news. - Obama WOULD be re-elected he had no doubt - at the end of this year or early next year the "serving" fee if you would call it would be waived. Now he has been correct about two of the three things so far. I asked him if i should go ahead and do the DACA and he actually said "if you want to, but this waive law will pass and itll be a waste of your money. But its up to you." As you can imagine my skepticism, i went with the process and feel more comfortable doing so. I have high hopes that he is right and everyone can get their situation fixed and we can ALL live the American Dream! Share this post Link to post Share on other sites
JoseG 383 Posted November 16, 2012 DACA will not help your husband during the process off adjusting his status as far as not having to leave the country. There are talks of a new waiver that would allow people who entered illegally to not have to leave the country, therefore not being in danger of being banned from entry for 3/10 years. Never heard of it, would be fantastic if it became a reality in the future Well, the applicant would still have to leave the country to go to a Consulate and apply for a visa, but with the waiver, their unlawful presence time would be forgiven and they would no longer be at danger of being banned for the 3/10 years.
