Hello if you are currently in Mexico can you apply for dream act

Hello if you are currently in Mexico can you apply for dream act, just currently went to go get papers about a week and a half ago, was denied because considered an "adult" yet only 18 getting ready to graduate highschool, can I apply for the dream act now and get sent back to the USA to finish my highschool, have all the requirments to apply for the dream act, I have to stay in mexico for awhile for "punishment" yet I did nothing wroung, I moved here when I was 5 and have been here every since someone please help I need to gradute highschool this year so I can continue on with life.

Also was sent a letter to go to get my papers in Mexico but been in the US since 5, its last year of highschool am a senior and need to gradute, my parents made me come here for the american dream and im dedicated i will get it

I could barely understand what you are saying but just the fact that you're in Mexico and not here in the US does not qualify you for Deferred Action

Hi,

I am not sure under what circumstances you are in Mexico. I would advice seeking the help of a competent lawyer because we are not qualified to answer these kinds of questions. As Enjr mentioned, one of the requirements for deferred action is for the individual to be present in the US at the time of applying.

It sounds to me like you went back to Mexico to apply for a Visa, but of course you were denied because you have been living in the U.S. and you are now barred from entry for 3/10 years.

If that is the case, that's the same thing that happened to the girl that went to Tijuana to try to get her visa and is now stuck over there. To be honest, I'm not sure if there is anything you can do about it.

One of the requirements is to be present in the U.S. at the time of applying, and if you are stuck in Mexico, you won't be able to apply.

No, you Cannot and does not qualify for he deferred action since you were sent back to Mexico.

Is there any way possible they can get back to the us so they can apply.

and they have all reqiruemnts for the dream act besides being currently in the us because they went back to get papers but was denied them untill a later date.

being in the US on June 15, 2012 and being currently in the US are 2 of the requirements for DACA. i honestly do not think there is a way around it.

can you get a visa if denied papers bcause u need to serve punishment, but I am legaly a minor for immagration because adulthood for immigration is 21 so why was i denied

What do you mean by papers? What were you trying to do down there in Mexico?

For immigration, once you turn 18 you start to accrue unlawful presence, that is why they aren't letting you back in.

How long is your punishment?

and honeslty I dont know what papers and I was told that they had 3 to 6 months mabey even more but that will destory graduating from highschool
